No, as long as you are happy to attend their choice of court. DE will take it to court and usually win.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Even though I am still waiting for a response from DE saying that I wish to use the Consumer Ombudsman which I am well within my rights to do?

As has already been said DE have a court record. That said this is the first case for some months.

DE major on the effect their signage has to bind motorists to the contract they contain (their PCN's are based on the supposed agreement to pay the charge for overstaying/parking out of bays etc - their PCN's are not based on the more usual breach of terms). With that in mind if you were parked at the site of a customer and - seemingly they are prepared to stand that up - then the argument has to be (having been given permission to park) that you had no intention to create legal relations. DE have side-stepped that argument in the past and may struggle to prove otherwise.
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com
