Apcoa parking charge notice - another one I know!

    find a 2015 apcoa airport appeal for birmingham or luton on here (using the search box , there will be many hits)

    copy and paste their appeal , then alter it to suit both your "case" and in the light of the Beavis ruling removing the parts that are no longer relevant

    most of the work is already done for you due to the hundreds of previous cases, all you do is the best you can with any recent 2015 threads on here, preferably ones from the last few months

    appeal points are

    POFA2012 does not apply to the RK as an airport is not relevant land
    no parking event took place
    no landowner authority to pursue charges
    poor signage (doesnt meet the BPA CoP)
    camera accuracy
    no reasonable time given to any perceived parking event (clause 13)

    anything else that is relevant from previous appeals
  • And as Nigelbb said above, are they wrong on saying that as the registered keeper I am liable?

    all the previous comments are relevant

    you have already had 2 weeks to draft your popla appeal, scouring the forum for previous examples (of which there are plenty)

    thanks for all the comments. I have tried to trawl through all the threads but can't find a draft or template or someone else's letter for a popla appeal for an apcoa parking notice at Birmingham. Can anyone help and give me a link please?

    its working fine for me and example threads do appear if used correctly
    plus it was working fine last week on the 5th when I replied too
    and it was working fine in the previous 6 weeks since his initial appeal went in

  • I'm filling in the popla appeal website page with the following. I have found it difficult to track down appeals here whatever anyone says but this is what I have written
    I reveived a PCN from Birmingham airport together with together with photographic evidence of less than one minute. I have appealed the charged to Apcoa which was refused. I am the registered keeper. Firstly Apcoa are telling me that as the registered keeper I am liable for this ticket unless details of the driver are provided. They also state that they are not using POFA. It is my understanding that this is totally incorrect and an unfair commercial practise which could be reported to trading standards and even the Police.

    The appeal is also on the grounds that no parking took place. the photographic evidence provided shows a timespan of less than one minute.

    There is also poor signage. A person would have to stop for a period of longer than one minute to read the signage - that is taking into account a person of reasonable reading capability.

    It is my understanding the Apcoa does not have the landowner authority to pursue these charges and that POFA 2012 does not apply as this is not relevant land.

    Can anyone advise please

    So there's 3 to be having a look at. Don't worry if they're not all B'ham airport. They're all airports with similar issues for you to read up on.

    Please don't just copy and dump anything that just looks good from them, try to understand what you're writing.

    With a good POPLA appeal, APCOA don't often challenge, handing you a win on a plate.
