Although I think I have been slightly misunderstood (me not explaining myself properly!)... I have asked powergen that I only pay a smaller payment just for the next few months as I physically cannot give anymore. As soon as I've had my baby I'll be able to pay out of child benefit (and child tax credits if we're awarded them).
My problem was that I had made an offer that I was able to afford and they refused- that was also the first time they gave me an usage of £61pm :eek:
I wanted to know what my next steps were as I'm offering money and their not accepting- I'm not refusing to pay to pay the debt.....
I think that you have made the position quite clear.
It is quite simple, you have made an offer that Powergen find is unacceptable and they have explained the reasons - your offer will mean the debt will not be paid back for 6 years.
I don't agree with whoever in the CAB told you "it won't stand up in court". It may be a realistic offer from your point of view, but not from Powergen's!
I suspect their next step will be hand your case over to the debt collection agency.0 -

Your landload definately isn't responsible for the debt no matter what. However, the Supplier can force the prepayment issue by gaining a warrant against the property to change it. The landlord owns the property, not the meter so unless it's in a locked area that would cause him hassle, he hasn't got much say in the matter and the Supplier won't care what he thinks. You are liable & also responsible for discussions about the meter. If no drilling into the property is required, the meter can be changed without agreement, it's your account with the Supplier, not his!
The Supplier will be more willing to take it slow if you are writing through the CAB as you are considered at risk in those circumstances and would prefer to avoid any bad press.
6 years they will never really accept, they are always wary over 12 months due to the new rules. If it goes to court it's up to the magistrate. I've seen a case once in telecoms where the court ruled the customer was unable to pay more than £1 per month (the supplier didn't help themselves in their attempted treatment). Consequently, the supplier wrote the whole debt off because the customer had to pay by cheque and the court also ruled the supplier would have to send out the SAE's hence they would never really recover the debt. Funny eh!
The CAB can give you free legal advise against these pushy companies so keep it up with them.
Cardew is right on that, you can only pay back what you spare which will be recognised in any court.

i have the exact same problem but with southern electric.
Me and my ex somehow got a VERY big bill at the old house with storage heaters, and a house that wouldnt get hot in winter for 3 years. At my new house the electric is with the same company and they will not accept a plan as they seem to think a previous plan was set up when it wasnt! they will only give me a meter that u do not want as more expensive and the landlord does not want it, so im kinda stuck what to do! I wish it was £250 but its much more
I have kept up to date on the electric for this house but now as a single mum working full time dont really have many more ways to make extra money. Also due to go bankrupt soon and deeply sunken!£2 Savers club £0/£150
