What do you mean? POFA allows an unpaid charge to be chased. It reads (IMO) as if it's was intended to cover people who underpaid and pay and display car parks, and this whole overstay/breach in free car parks is an unintended (and potentially invalid) consequence.

Section 16, page 24.
It is provided free to motorists;
Its decisions are binding on the industry (but not on drivers and
registered keepers); andI'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0 -

But from page 15 of the same document:
"The registered keeper has 28 days after receiving a notice from the landholder in which to provide the driver’s details, pay the parking charge, or appeal against the ticket."
Am I right in saying the £15 is for appeals brought after the statutory 28 day period, whereas at the moment appeals are not (except in rare circumstances) accepts outside 28 days?New members, please refer to "sticky" threads that are alwasys "stuck" at the top of this forum0 -
Its a condition of membership that they agree to the code of practice which says that they do not charge. But saying they will do, is this breaking the conditions of the code and so should not be able to get keepers details from dvla???? It can't be as simple as this surely.I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0

"The appeals process is provided free of charge to the appellant and is intended to complement the Operator’s individual, internal appeals procedures when dealing with contested parking charges".
So the IPC are actually in breach of their Code!0 -
Though the appeals system should be independent? I know we all know that the IAS are not independent, but surely they shouldn't be linked like this?
Taken from link earlier in thread:Official name of ADR body: The Independent Parking Committee Ltd trading as The Independent Appeals Service0 -
G24 practices are not up to principled standards - evidenced by their reply to my letter objecting to Contractual Parking Charge Notice. Their letter dated 04 Sept 2015. Received by me via post on 17 Sept. Page 2 details option 2 inviting me to object to IAS. "Appeals must be submitted to the IAS within 21 days of the date of this letter."
IAS appeal procedure is online - Arghhhh! Am not so good online.
Scurrilous practice shown by holding onto their letter for nearly 2 weeks to thwart me.
This is no fun at all.
They mention "liquidated damages" many times and contradict themselves. Plus they ignore most of my points. Arghhhh!0 -

Just as there are dodgy garages with AA accreditation, and dodgy letting agents who are members of ARLA, this accreditation by the IAS means very little.
It will only be as good as its decisions.
If you have substandard work done by an AA recommended garage, complain to the AA, and, if your complaint is upheld, they will provide a remedy, so I imagine will Ombudsman Services will also operate.
Although recent experiences by Crabman and myself
https://forums.moneysavingexpert.com/discussion/5226710=
have not made the best of impressions, as most of the PoPLA staff have been tuped from London Councils, I am optimistic that there decisions will be acceptable. You never know how far you can go until you go too far.0 -
Thank you peter-the-piper. I have started a new thread. I thought I had followed advice and was going along with procedure but some panic set in when I received the G24 response.0
