Shipping "adjustments"

Hi,

This is not actually ebay related but I can't find a more suitable forum for the question and I know most here have experience of online buying.. so here goes..

I bought a couple of kids toys from a company in Hawaii and the total, including shipping, came to $250. The amount was charged last week and has already appeared on my CC statement.

However, today I got an email from the company stating that I had selected the wrong shipping option for the weight I had purchased and that they were adjusting the shipping fee by $35 to cover it. So I have re-checked my CC statement and i can see that the $35 is a pending transaction.

My question is, are they allowed to do this? If they charged me $250 initially, surely this is the price they are obligated to provide the goods at, and a 2nd transaction would therefore be unauthorised? They have already shipped it, so I basically want to know if I have the right to cancel this extra $35 charge?

Any help, or recommendation of a more suitable forum, greatly appreciated.

Thanks,
Gordon

This smacks of an error on their part and I would be inclined to cancel the $35 by calling credit card company and advising situation. A system that allows the purchaser to "select the wrong shipping option for the weight purchased"??? ..... hhhmmm..... Sorry, but I don't buy it, instinct says they cocked up. ;)

  • Any shipping rate discrepancies will be adjusted appropriately. I.E. If your order requires a large box to ship or the total weight exceeds the original shipping rate, we reserve the right to charge additional shipping charges to ship your order. Also, if you choose Global Priority for an item over 4 lbs, we will adjust the cost and ship the product USPS Global Express."

hmmm found this on the shipping info page for the site. Even though they "reserve the right" (is there such a right to reserve??) to charge extra, would it be legal for me to reserve the right to not pay more than I was expecting to pay?

Especially the part where they state "additional shipping charges to ship your order". They have already shipped mine, and infact it just arrived this morning as I was out shopping! (at depot now)
