Amazon Fire TV Box Faulty - Returning

I got an Amazon Fire TV box a month or so a go. It started not recognising the remote or x box controller I had paired to it after about four weeks. I fiddled around changed batteries etc still it wouldn't recognise it. So I did a factory reset it then recognised them both again. When I put the original batteries back in a day later it said low battery. I changed the batteries, I've tried rechargeables I've tried brand new duracells. It seems to eat batteries. And it seems random, works fine for a week then drains the batteries in the remote right down. And this is watching maybe an hour or two a day max. Maybe three times a week.
Googling reveals this is a known problem caused by the box not the remote.
Anyway I want to return it BUT Amazon have discontinued this version so I'm concerned that I'll end up with a refurbished one. I don't see why I should get stuck with second hand as I only bought it recently.
Has anyone got experience with Amazon electronics when you need a replacement but they no longer sell that version? I'm stuffed aren't I?
And yes before I get a lecture I know refurbished is lovely you can't tell the difference - I don't care I want a new replacement I bought it less than two months ago, please don't debate me on it, that isn't what the thread is about

See what Amazon say first. The new 4K version is out in October for the same price which could go either way for you. Bear in mind they may still have new stock of the discontinued box, and you don't have any right to insist on the upgraded version. On the other hand, Amazon are usually pretty on the ball with customer service, so you might get lucky.0

Since its a fault rather than a change of mind, I'd be half tempted to wait a month until the new one comes out. You might stand a better chance of it being replaced with the new model that way.0
