Official Receiver's form?

My husband declared himslf bankrupt yesterday after 15 years of struggling. Personally, not his company. The official receiver rang him today for a chat and everything was fine but he said he will be sending a form for my husband to fill in.
Does anyone know what this form might be?

Probably just things like the forms giving HMRC consent to release info to the OR, DPA consent, a notice telling you of your duties and obligations under insolvency law that you have to sign to say you have read... That sort of thing. Nothing to worry about.

  • Just wondering what you mean when you say 'personally, not his company'..is he a director?
  • He drives a van for himself. The company doesn't make much money, but he took out some personal loans years ago.
  • Ok, thanks for the reply..he's not a company then, he's a sole trader.
  • This is common you generally get a few set of forms after the phone call. For example to confirm everything which was discussed over the phone and any amounts you need to pay back or information about going on a NIL tax code.

Thanks for your replies. It was, as you said, just more the signing of letters to let them do things more than actual forms to fill in.

Will there come a point in a few weeks perhaps when there is a finalisation letter?

At the moment there are still things going on like OR informing landlord, half of money has been taken from our account to pay creditors, which we agreed upon, ....will the £1 per month that we were paying creditors (on their agreement by DD) stop on their own or will we cancel the DDs?
When is the OR likely to tell us how much to pay each month?

I don't want to do anything to soon ...just wondering if there will be a letter to say it's all sorted and we can carry on.
  • Cancel the Direct Debits, the creditors won't cancel them :)

It shouldn't take too long for them to decide if an IPA is payable, was there deemed to be any surplus after the interview?

Well we had some PPI refunds back with the help of CAB and had to use some to get the car in working order. In our forms we told the OR that there was £4800 which was to go to creditors but when they rung my husband up the other day they said they would be taking half of that...which they have today.

So, you are already £2,400 "in profit"! Not as bad as you thought, is it? ;)

I personally believe they have looked favourably on him as he is 78 years old and works from 4am to 6pm Mon - Fri and 4-10am Saturday driving and has been having financial troubles for so long.
