My neighbours guttering is full to the brim, if it continues anymore it might be considered a protected woodlands. If he has no downpipe of his own then don't cut it.
If he does then go ahead and cut it, entirely on your side. So technically you want to leave 1cm of your guttering connected to his and capped off. Then the rest of your guttering is independent.
