My daughter was 16 after 1/9/13 hence born after 1/9/97 , in the past my liabilty would have ended 2 years ago. But from frequenting this board I have learned it could go on a while longer. I don't see FT jobs for under 18s and even when I left school all those years ago CB was often paid until 18.0 -
Wow Dutr, you really seem to dislike anyone who asks a question like this and FYI i brought up my first 2 children up on my own without any csa help from my ex, which was fine by me as i i managed to do this by myself even though i struggled and I am now bringing up my other 2 children on there own so its not about whinning or what i have done for my children as i have had to be dad and mother. Instead of reproaching me why dont you please stay out of my request for information regarding my question if you have nothing to offer other than abuse.
Yes there seems to the concensus that we all will have to pay longer but im trying to learn where in actual law it states this because as of this date the child support law does not state that of which you say0 -

Thanks for that, my daughter was born before sept 97 so the school age may be 16 in her case unless i can find anything to the contary
Like I said, if Child Benefit was still in place then CM would have been due. I think its something your MP will be able to solve a lot easier and quicker than you can.

Yes it is, as its money my other children ould of done with, but if it turns out she was entitled to it even though she had lied to cb then fair enough as all my children deserve any help that my money can bring. Thanks for the help as i will be involving my local MP, buts its always good to seek out others for advice as perhaps they may have experienced something similar or the same0 -

I'm not sure how you arrive at that conclusion, then you add FYI, I'm not interested in the emotional stuff we all have crosses to bear, you were asked earlier if they CSA told you verbally or you had it in writing that the liability has ceased? That you have not answered (probably purposely) it side tracking away from the facts that brings on the troll alert.
I'm sure you are not a loser, but the most bizarre occurances happen to happen to that type. Raising other children has little to do with the facts in hand.
Let me ask again for the readers did you get confirmation in writing that the liabilty ceases from such and such a date?;)
The law is simple on this issue, CB payable? if yes CS is due.0 -
Dutr had you read my very first post properly rather than accusing me of whining you would of noticed that i had already stated that i had received a letter from the csa saying my liability had ended. but just to clarify for you the said letter was dated 3/8/15 stating the following: that my liability has been cancelled or ceased to have effect for my daughter . and that the liability for child maintenance ended on 29/8/2013. the 2nd letter received after this said my child maintenance case recently closed with effect from 29/8/13 because the qualifying child was no longer in full time education0

In the opening post it included
"I suspected my ex of fraudulently claiming csa as i was reliably informed that my daughter who is now 18 left full time education quite sometime ago. I informed cb and csa about this and about a month ago i received a letter stating that my liability for child maintenance ended on 29/8/13 which is two years ago. I contacted them and they advised me it would be looked into and any arrears or over-payments would need to be looked into. They recently contacted me stating that they had looked into this and that i was due a repayment and said i would get back my last 2 months payments. I queried this as i was expecting it to be backdated 2 years, and they quoted section 41B (2) and they deemed the payments made were classed as child maintenance payments for the upbringing of my daughter even though she has left full time education as they said the pwc said she had supported her for the last 2 years at home. I do not have any contact with my daughter (alas) but was told by the same person who told me about her leaving college that she was working full time in a care home but i dont know where. My ex has obviously been claiming child benefit as i have got them to check in the past. How can the csa only partially refund this, when they have admitted my liability had stopped 2 years ago. there is so much conflicting information about this as the csa refuses to print guidelines on this matter."
So me re reading the opening post and highlighting the 'relevant' bits suggests that it was a recent communication with the CSA and that the date on the letter contains a typographical error as in the year.
So have you been paying for the last 25 months even though you had a confirmation letter 2 years ago?
Whether the mother has committed fraud or not is not your main concern and to me just suggests a lingering bitterness, get your over payment back 1st if it is indeed due.0 -
I think you would be best to stay out of other peoples posts if all you can do is ridicule as you have said loser, bitterness, and whining, without even knowing anything about me other than what i have posted here. Can't help with the csa side but with regards to school leaving age to the best of my knowledge and I concede I may incorrect it is as follows...
Children born before 1/9/97 had no obligation to stay beyond sixteen.
Those born between 1/9/1997 and 31/8/1998 inclusive had to remain in education until 17. So a staggered year? Bit like they staggered the pension ages to get them all the same.
Those born on or after 1/9/98 remain in some type of education until the academic year they turn 18.
My nephews born March 98 and June 98, stayed for one yr.
My son Sept 98 has two yrs to complete.0
