Hi All

I had an agreement with Jacobs to Pay £50.00 per month off a council tax bill.I set the agreement up in June.

Although I haven,t paid £50.00 every 31 days as per the agreement .
I have paid more than £50.00 every month after June.

12th June £50.00
20th July £75.00
17th August £60.00
08th September £100

You can imagine my total amazement when a Bailiff from Jacobs turned up on my doorstep demanding full payment of the balance £950 and put another £50 on top just for good measure for breaking my arrangement.
It was first day of school for the kids so I asked if he could come back later to discuss this once I had taken the kids to school and shut the door.

He got in his car and drove off. On returning back from school I found a hand delivered letter stating he was going to remove goods in 24hrs. {He Didn't)
I rang his off ice to find out what was going on, they where no use just told me to ring him. So I rang him and he is just demanding full payment or he is coming to remove my goods. I've now started getting text messages from Jacobs telling me to pay in full or the Bailiff is coming around in the next couple of days to which they will add another £235.00 to the bill.

Could someone please give me some advice on what to do I feel like I am banging my head against a brick wall with these people.

Many Thanks
Frustrated

Make a complaint to the finance department at the council?

And keep on at the bailiff office as well. They will be the party originally in receipt of the instruction from the council, not the individual who actually turns up.

I have no idea how the law applies to stuff like this, but it sounds more of a pragmatic issue to start with.

Hi Wideeyes and welcome to MSE.

The key issue here is have the bailiffs ever been inside your home before and/or asked you to sign a Controlled Goods Agreement with your belongs listed on it? If not then you must not let them in. They can only come inside your home if you invite them or if there is open or unlocked access. If you have anything of value outside your home (like a car) and it is not subject to a Controlled Goods Agreement - then hide it!

Unfortunately if there is a Controlled Goods Agreement and you did not maintain it then the bailiffs would be within their rights to force entry for those items (although this is very rare). You may be able to consider a complaint to the bailiff company because from the dates you have given the agreement was broken in July but they still accepted August and Septembers payments. This is can be a complicated issue and if there is a Controlled Goods Agreement I think you should seek full and independent advice ASAP.

  • When you set up the payment arrangement was it over the phone following the Notice of Enforcement? If so, were you advised of the date when each months payment must be made by?

I note that you made a payment of £100 on the 8th of September. What date was the recent visit?

I am very concerned at the mention by you of a 'late payment fee' of £50. Can you confirm if that this has been added to the account? Is this additional charge written down on any documentation?

I had an agreement with Jacobs for £92 every 31 days in December 2015, due to loosing one of my clients I am now down £34 per week. I contacted Jacobs to sort out a new payment plan and expanded everything but they had non of it. I was even willing to do another income and expenditure but they were having non of it.
