TP Toys

We bought a TP climbing frame summer 2008 which had a guarantee for the wooden parts. It now has major cracks within some of the wooden uprights. I contacted TP Toys who informed me that at the time we purchased the frame there was a different company owner who has since gone bankrupt and were no longer trading. And as a result the wood guarantee was no longer valid, despite the fact TP Toys still appear to have the same trading symbol and items for sale ?? Is anyone able to give me some advice ??

It has been over 6 years so you have no rights I'm afraid.Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')
No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)0 -
It sounds like they have certainly changed ownership - their history page lists a new owner in 2012 https://www.tptoys.com/customer/pages/tp_history
It would then depend on whether they bought the whole company as a going concern, or just things like the name and logo. Unfortunately there's not really any way to check up on this, other than taking them at their word, so I don't think there's anything else you can do.0 -
If the company that offered the guarantee at the time of your purchase no longer exists then seeking a remedy from them will be impossible.cheryl_williams wrote: »We bought a TP climbing frame summer 2008 which had a guarantee for the wooden parts. And as pinkshoes says, you have no statutory right under The Sale of Goods Act.
However, if the guarantee hasn't expired and was offered at the time of sale, and you made the purchase via a credit card, then the card issuer may be responsible for providing a remedy under that guarantee.
Have a read of MSE's Section 75 article.0 -
Any guarantee would have been with the original company. Unless you can prove that the current TP Toys is the same legal entity as the old TP Toys (in which case you could take them to court to enforce your rights, since the guarantee/warranty formed part of the original sales contract), then you've got no claim.
Edit: except for the S75 possibility mentioned above.0
