How do manufacturer updates affect warranties

I have a WindowsRT tablet that is coming up to two years old so isn't covered by the manufacturer's warranty anymore and is just about covered by the two year EU rule.

Now my tablet has an issue whereby if it goes to sleep it won't wake up, it has to be manually reset which means everything unsaved is lost (internet tabs, game progress, etc). When using some apps it'll even do this when the screen just locks itself.

This is a recent occurrence and I've done a factory reset and the problem only came back when I fully updated my tablet so its definitely a manufacturer's update that is causing this.

As this wasn't a fault from when I purchased it and taking it back to its purchased state resolves the issue I'm guessing it isn't covered by the EU directive. Does the manufacturer's warranty cover me for updates they supply even if the manufacturer's warranty has expired? I can't just not install the problem update as I don't know which one is causing it and there's been a few hundred updates since I bought the tablet
