    Seriously it doesn't matter much in Scotland, but the letters might contain some useful hostages to fortune and hence be worth hanging on to.

    I am in Scotland too and have just received a final demand letter. Why doesn't it matter if you live in Scotland? I threw the other letters away but this one demands £85 with a week to pay it got me worried, will they keep pursuing?

    In Scotland the PPC can only claim money from the driver, and the keeper has no requirement to identify them or even acknowledge the invoice.

    Therefore it's completely unenforceable and can be safely ignored.

    Unless they can prove in any way that the RK was the driver at the time. Usually that is difficult but many RKs are their own worst enemies by what they write in any appeal to the PPC. Luckily you have said nowt so good on you.

    I believe they can only prove who the driver is if the RK tells them, they can't make assumptions based on anything else (like the name on the card you used to pay for parking or shopping, or visual identification, or the car park access for id). So if the RK ignores them, they have a serious uphill battle to deal with.

    At least they know better than the follow the IPC and "proceed on the assumption that the RK was the driver" because they'd be probably be asked to bring a toothbrush to the next hearing.

    If any correspondence states that the registered keeper will be liable under the Protection of Freedoms Act (POFA), then contact your local Trading Standards ... such a claim is illegal in Scotland, and is (partly) why CEL are being prosecuted in Aberdeen. :)

    On the subject of POFA I see that faulty cameras r us, I mean UKPC, are now "inviting " the RK to pay or name the driver.

    They are also now threatening Sheriff Court for recovery of "interest and court fees", but not the original sum. Now I'm worried. :-)

    Dear Sir/Madam

    We note from our records that the previous two Parking Charge Notices we have sent you, which refer to the Parking Charge issued in accordance with the terms and conditions for parking at the X car park on X date remain outstanding.

    The amount payable is £85. This payment is required within 7 days or further action may be taken.

    If this letter is ignored, further action may include referring to a Credit Reference Agency to confirm the correct address, instruction of solicitors to secure immediate payment, referral to debt recovery or the issuing of court proceedings, all of which could incur further costs which may be added to the amount owed. To avoid further unnecessary costs or action, please pay the outstanding parking charge amount as stated above or make arrangements for the driver to pay. In accordance with the parking terms and conditions.
