Highview Parking Fines Help !!

Guys Recently I have revieved two parking fines for overstaying the three hours limit which is clearly sign posted in tesco . I recieved these in the post , one 14 days after the offence but one 14 days before the offence. Since I have two cars , there is one fine for each car . In both letters they state that tesco have overlooked the fact that i had also overstayed on a previous day but now they are taking action. Now I am wondering as to whether I should pay the reduced amount of 40 pounds each or appeal . Any advice? ?

Appeal. they have to prove loss, contact, planning permission signs, Locus standii, they have a mountain to climb.You never know how far you can go until you go too far.0

Do not pay, do not ignore, do not reveal who was driving.
Read the Sticky thread for NEWBIES and appeal using the template letter contained within exactly as it is.
Then, complain to Tesco management (not customer services) and or the CEO.

Ok , Thanks guys , also i read somewhere that there is some protection from harassment law that peotects means they can't send these letters after 14 days . Is that true ??0

no , they have 6 years to try to claim under the small claims court and they can send letters out regardless, which they do , a lot !
you can try to stop the harassment by sending a denial, but they will say their client has engaged them and they can do so as that is their business
these are not fines, they are invoices (speculative)
they are not "offences" either
appeal , plus complain to the landowner too0 -
ok thanks, i have also been reading the thread which asks us to compare the wording of the postal letter to the to paragraph 9 of Schedule 4 of POFA 2012 . As far as i can see the only thing they neglect to tell me is that if after 28 days they dont recieve payment and know who the driver is, they can pursue the keeper for the charge. Can I use that in the appeal? If not i will just send the generic appeal0

(i)the amount of the unpaid parking charges specified under paragraph (d) has not been paid in full, and
(ii)the creditor does not know both the name of the driver and a current address for service for the driver,
the creditor will (if all the applicable conditions under this Schedule are met) have the right to recover from the keeper so much of that amount as remains unpaid;0 -
Use the appeal in the NEWBIES FAQ sticky exactly as written there. The legal stuff from PoFA can wait for POPLA. Highview will not uphold appeals based on PoFA irregularities in their paperwork - they will probably see it as hair-splitting and playing on words (just like they do with the BPA Code of Practice) but, WRONG! PoFA is THE LAW and they've got to get everything right to pursue the keeper.
Tesco won't be recording or reporting back your conversation with them to Highview, so trying to sidestep around who the driver might have been might make it difficult to make your point. But why worry about telling Tesco who the driver was when you've already provided that information for the whole world to see, right here in your post #9. Do you think PPCs don't read these forums? Edit time!
You send separate appeals for each ticket. The only thing that will be different is the unique PCN number. Follow Highview's requirement for how appeals should be submitted to them, whether via their website, or email or post. If the latter, get a free certificate of posting from your Post Office for each letter.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

1. Were you shopping at the store and used a credit card to pay? Take your credit card statement in with you to prove patronage. There will also be proof if you have and used a Tesco Club Card to have your loyalty points credited.
2. If not, are you normally a regular Tesco shopper? Again take credit card back-statements and/or your Tesco Club Card.
3. There are no magic words we can give you to make them change their mind. But who have you spoken to at your local store? Customer Services (useless) or the manager (more likely to get some action)?
4. If no joy locally, you need to escalate things to Tesco HQ - ask the manager to give you the name and email address of Tesco's Chief Exec, so that you can now approach him given that the local manager is refusing to intervene.Please note, we are not a legal advice forum.
