Parking Eye Ltd Final Notice - Queens Hospital Burton on Trent

Hi All,
Help need please.
I've received a couple of notice for parking at Burton Queens Hospital, Burton on Trent relating to April, 2015 from when I rushed to my wife who had been admitted due to pneumonia.
I have ignored the two previous letters but have now received a Final Notice from Parking Eye Ltd who are based at a PO Box in Chorley.

It states

"that payment is required in 7 days or further action may be taken."

"If this letter is ignored, further action may include referring to a Credit Reference Agency to confirm the correct address, instruction of solicitors to secure immediate payment, referral to debt recovery or the issuing of court proceedings, all of which could incur further costs which may be added to the amount owed. To avoid further unnecessary costs or action, please pay the outstanding parking charge amount as stated above or make arrangements for the driver to pay, in accordance with the parking terms and conditions."

Please can somebody advise if I should worry and need to pay or if it's just them trying to scare?

Many Thanks in anticipation.

  • Parking Eye are a company of chancers and liars.
Over the past 4 months my wife and I have received SIX parking charge notices for parking at Macclesfield Hospital. We have valid tickets for all 6 instances ...... but their latest scam is to claim that production of a valid ticket is 'insufficient evidence' that we had paid and so they have refused our appeals !!!!!! What other 'evidence' do they require?...... we paid, we parked - and thankfully we kept our tickets.

I'm more than happy to face them in court ................ DON'T LET THE BULLIES WIN.
I wonder how many innocent people pay up because the threw their ticket away or are intimidated by the actions of this disgraceful company?

  • Thank you for the help so far but I'm really struggling with the information on the link, so much information to take in.

The first letter was a parking charge notice which was issued two months after the event. My car is a company car which is leased and there first letter advise that they have a company of my signed hire agreement and statement of liability, not got a clue were they get those from?

Please could some one help as I'm in two minds weather to make contact with them or not?

    Kind regards

OK. You missed the deadline to appeal to POPLA so you are now in the wait and see phase. An appeal to Parking Eye won't get you off unless you have a really strong appeal backed by Hospital Doctors' letters saying that your wife was at death's door and even then you would be lucky.

Parking Eye are very litigious so they will quite possibly instigate court proceedings.

You can try to use the hospital PALS appeal service - hopefully other on here can advise better than I can or you could use Google while waiting for such advice.

No point in going over what you should have done re appeals - but for your own sake, get clued up for the nest time.

Last of all do NOT ignore any letters from Northampton court.

This is one you need to be careful with, follow the advice above.
Also take a read of this http://www.clearest.co.uk/pages/publications/articlesbyourteam/parking-language and the article on parking eyes unclear signage.
it May also be worth getting in touch with the local press as well, with all the UKPC media attention PPC land is currently in the media spotlight to an extent.

Again the best option would be the Hospital, you could say / let them know that you are shocked by the plain language commission report

you should assume they will take this to court and you should try to follow the LBCCC fightback details in the crabman sticky thread ASAP

yes its a lot to take in, you cannot be expert in this field in 20 miuutes , 20 hours or 20 days of reading and research, but you have been "picked" to play regardless and so need to get "up to speed" or you will be facing a court claim from Northhampton very soon IMHO

start the paper trail and start with the LBCCC thread, then try to see how this should have been tackled (popla) and if court papers arrive try to steer the defence towards popla if the judge allows it for ADR, or a stay pending the outcome of the Beavis case next month (this will probably come out long before your court case anyway)

if you thought this was going to be an easy topic to learn, you are sadly mistaken, its a legal case and legal cases can be and are complicated , hence you try to head them off at the pass with a strong complaint to the CEO at the hospital, PALS at the hospital, your MP , an LBC type fightback letter , newspaper publicity etc

bear in mind Barry Beavis has been to 3 courts in front of up to maybe 10 judges in total (at least 7 if not more) because he ignored a parking charge invoice , he was probably naive and knew nothing about the topic when he started the legal path , so he had to get "up to speed" too, because he was picked to play the game, regardless of knowledge or ability

in simple terms, once you received the original pcn invoice, they had 6 years to bring a court claim to try to enforce it , they are almost at that point, they issue over thirty thousand court claims per annum, you will be next on that list

ignorance is no defence, so not understanding any of this wont stop the legal juggernaut heading your way
