I live in England and received a PCN from Smart parking for the Watergate Street Car Park in Perth. I did overstay by 40 minutes (and I didnt buy a ticket for the first 20) so my actual issue isnt being fined for overstaying its the level of charge for overstaying. I have appealed to smart / TCP by writing the template letter that was on this site claiming that the charge is disproportiate to the actual loss by the landowner. This appeal has, of course been rejected. I ended my appeal by saying that I would not enter into any further discussion with them, so my question is...do I do that and move into ignore mode or pay up?
Does Scottish law still apply even if you are resident in England?
The email rejecting the appeal has their registered company address down as the following : - Smart Parking Ltd also trading as Town and City Parking, registered in Scotland (SC138255), 5 South Inch Business Centre, Shore Road, Perth, PH2 8BW although the hard copy letter has a UK address on. My apologies if I'm repeating anything but I can only see posts where people have unfairly been charged not when they have actually overstayed. Thank you,

They can't raise a small claims against you in England and Wales, so sit tight and ignore them from now-on.

Not specifically but I did use the words 'I would have had to park for...' so I guess thats tantamount to admission.0

I know there are lots of threads but not any that were exactly the same circumstances as me, ie england resident and overstayed. Thanks for replying.0 -

Its not impossible but it would need a higher court or a special order so the costs involved make it very highly unlikely - Small Claims is the means most PPCs use to try and get money out of you and there isn't an easy way to make this work cross border.

We don't need to hear about these letters again, thanks (sorry of that seems harsh but we can't go over this again, people have been ignoring that letter chain for a decade). Please just read the NEWBIES thread post #4 about 'ignore the debt collector' stage where there are links to these tedious letters.
Nothing about Zenith or PCS letters either please. Google them - choose a phrase from each letter and Google it!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
