Getting an incorrect default off my credit record

I have a default on my credit report that was lodged on 28th Dec 2013 which is nothing to do with me, it a Scottish Power Gas bill that for some reason my tenants managed to take out in my name and have not settled their final bill so I have the £42 outstanding on my file, which is really annoying as its causing us a problem getting a mortgage as it was dated within 3 years.

I have no issue with settling the debt as I withheld the amount from their deposit, I do have an issue with it being registered as a default on my account and I have spoken to Scottish Power several times over the past 2 months about taking this off my file and they seem totally incapable of doing this for some reason, I don't understand why it is so hard when it seems so easy for the to put it on my file in the first place.

I want to know what I can do about getting it off my credit report when Scottish Power seem to incapable of doing so, as they don't seem to be hurrying themselves, every time I call them I speak to a different person, who I have to explain everything to again and they always say they will get someone to call and nobody ever calls, I am at my wits end and would really appreciate some advice on what I can do!

    You may have to take or threaten to take the complaint to the energy ombudsman and the ICO to get any movement.

    If you feel that a defaulted account or any information has been recorded incorrectly on your Experian Credit Report please get in contact with us, we would be able to query the information directly with the lender on your behalf as you've mentioned you have attempted to contact the lender on a number of occasions.

    If your Credit Report is with another credit reference agency (CRA) I have listed their contact details below for your reference:

    Equifax Europe Ltd: P O Box 1140, Bradford, BD1 5US

    Callcredit PLC: Consumer Services Team, PO Box 491, Leeds, LS3 1WZ

    I wish you all the best of luck with getting the issue resolved and hope your mortgage runs smoothly, if there is anything we can help you with please don't hesitate to contact us.

    Complaining via Experian always goes this way.

    * You complain
    * Experian add a dispute
    * Experian f8ff around for a month saing they are waiting for a response

    * If they get no response they refuse to do anything

    or

    * If they get a response creditors know Experian are a moral vacuum and weak willed and in the pocket of the creditors, so they just tell them that the default is correct

    * Experain just say nothing they can do, not our problem, and leave you in the lurch

    Waste of your time whichever way

  • I thoroughly agree with rizla king.

    Had a similar experience with British Gas changing the name on a defaulted debt from my ex to my name as they couldn't trace him. When I moved out I still had an account with them so they had my details. I told them numerous times it was not my debt, and could prove that I had moved out as you could see my new account on my new address on my credit report running simultaneously as the other account even before it went into default, but it all fell on deaf ears.

    CRA's will just contact the lender then say there is nothing they can do when they refuse to play ball.

    Best to take out a dispute with the energy ombudsman as fermi suggests.

    Goo luck.

    I would be more concerned that your tenants were able to take out a gas supply contract in your name. How did they manage to do this I wonder? Have you reported this fraud to the police? The crime reference number may help in getting the default removed.
  • This is a major issue with British Gas, they have pretty much done the same with me. I am currently getting a letter together for the ombudsman. Anyone could set an account up in anyone's name, that person then comes liable for any debt. That's the exact words that came out the mouth of a complaints advisor. They are a joke!

    I will give you the number of the managing directors office who might be able to help 01784 874994. By all means give them a go.
