Tax Credit Overpayment Help

Hi everyone,
I have been claiming child tax credit for a while and last year in September i had my daughter come and live with me, After informing HMRC they updated everything and the payments increased for 2 children as i was already receiving them for my son.

After some time passed and with many personal problems my daughter was no longer living with us and i wrote to HMRC to inform them that she was no longer living here, i sent them 2 letters about 4 weeks apart.

I've recently had my tax credits reduced, to £22 a week which i am extremely confused by.
I was originally getting around £62 a week with just my son and it was then at around £115 a week when my daughter was here. They have updated the claim with her not on it and as they had still payed me tax credits for her being here as they did not get my notification she has gone this has resulted in an overpayment.

I phoned them yesterday regarding the £22 tax credit payment i got and the gentlemen said thats how much a week i will get going forward as they are taking funds off future award for the overpayment. I explained £22 a week seems really low, After doing some looking around online it was to my understanding that with just my son on the claim my payments would go back to around the £62 a week and then obviously a deduction off that for the overpayment which i thought would be 10% as i am in receipt of ESA, However after going through this question with him on the phone he said that its £22 a week i will get to avoid my being overpaid anymore. How could i be overpaid still if they have removed her from the claim?

Maybe i am not understanding the whole thing properly as i've never had an overpayment but i was just under the impression that if my daughter was removed the payments would drop to the £62 mark and then a deduction of that, It seems they are taking around £40 a week from that amount which seems quite a lot as i am really really going to struggle. I've looked around online and the only thing i can see is they are only allowed to take 10% if you have the maximum award ( which i do )

Is the man on the phone right in saying that i will only get £22 a week to avoid anymore overpayment, He didn't really explain everything very well to me and i eventually just said thank you for your help.
I hope someone might be able to give me a bit more help into understanding this as i'm really really stressed now knowing i will have to try and survive with just £22 a week tax credits.

  • Thank you for your reply.
I see, i've also just remembered him saying it would go up again from April 2016. It's going to be an extreme struggle between now and April 16 :(
  • I received an overpayment for a different reason, they couldn't update their system when my circumstances changed while concentrix were doing their standard checks.

My payments have dropped to £27 with two children until April and HMRC are saying the exact same thing to me

It's going to be insanely tight
