Thanks for all of your replies. The surveyor didn't call back today, so I am not sure what to do? Should I contact him again tomorrow, or maybe write a letter. As I have an invoice, I don't think I should leave it ?

    Hello,

Is this guy a professional Chartered Surveyor? i.e. a member of the RICS? You may have recourse through them if he gets too uppity.

Even if you didn't specify time was "of the essence", I would think that the report should have been prepared in a reasonable period of time.

I don't think four months is reasonable for a small business property. Especially since you chased him within 14 days making the urgency clear.

Don't pay him, and don't let his blustering force you in to submission.

He messed up - I can't see him trying to sue you.
