Capquest and CCJs

I would be very grateful for any advice anyone can give me. Background is I have 5 debts totaling some £20000 approx which I am paying a nominal amounts each month, varying from £5 to £20, I have been paying these nominal amounts since something like 2007 and the last default will come off my account next month. I had one CCJ (from HSBC) which has already come off my account. I am in contact with three of the companies, they write regularly and renewal my payment plan. The other two debts are with Capquest and apart from the odd text once in a blue moon, I never hear from them. I am quite happy to continue to pay and hopefully one day will be in a position to make an F&F offer and be done with them. My questions are (a) given the length of time I have been paying Capquest, what are the chances they will apply for a CCJ? I am divorced and am now renting privately.. I had terrible trouble finding a property last time as I still had the CCJ on my file and I have a fear that Capquest will go for a CCJ. I have to move as my son is spending a lot of time with me and I need a two bedroom flat but cannot move until next june when the current tenancy finishes; and (b) I have though about contacting Capquest to increase the amount I am paying but as I have not heard from them, i am scared of bringing myself to their attention! . First advice is to send a CCA request to all firms collecting debts money.
Try to narrow down if you can simple stop paying them as they dont have the CCA paperwork required meaning you are paying them on a voluntarily basis.I do Contracts, all day every day.0 -
dear Mark, thank you very much for your speedy response, am very grateful. Although this is my first posting, I have been reading the forum for quite a while, and have read about a CCA request. My fear is that they have been taking my nominal amounts for a long time, and if they feel I am being stroppy by asking for a CCA request, if they do have the correct paperwork, that they may get stroppy back and start making all sorts of threats again, including court or defaults (it is now so long ago I cannot remember who defaulted me and who didnt, sorry not very good paperwork on my part), what is your opinion on this? thanks again Rose0

Capquest do or did have a period where they often responded to a CCA request by issuing court proceedings. Always a risk when you up the ante.Still rolling rolling rolling......

Thank you Rizla, that was my fear so I think I will leave that for the time being. It is my debt so am happy to pay it. I am more concerned if they will go down the CCJ route if I continue to pay as I am now and whether, if I contact them to increase my monthly payment, am I just bringing myself to their attention and a whole lot of grief! What are the Capquest accounts for?
I would leave it for now and if they get funny, send a CCA request. No good for overdrafts.:beer:0 -
Thank you Happy Bunny. They are for a loan and a credit card so no overdraft. I am happy to keep paying as I am, I was just looking for some comfort as to whether they were likely to go down the CCJ route unexpectedly! I know no-one can say definitely one way or the other, but was just wondering if anyone had any experience? Rose0
