Tax Credit Overpayment

Omg... just received a letter from HMRC requesting a payment of £1017 from 2008. An overpayment.
From my recollection of this they misread the salary and i did not realise they had paid me too much.
I thought this had been dealt with...it was 7 years ago!!!
What do i do? Try and dig out all the paperwork (if i can find it, i moved 3 years ago.
Could someone please advise?!

    when you say you thought had been dealt with, were you paying the overpayment back and believe you had fully paid it?

    No arrangements for repayment were ever made. I do not believe i heard anymore from them. They misread the amount i had put down for my salary.

    I did inform them but i need to dig around and find the original paperwork. Have just read a Limitation Act
    HMRC's own manual states in the Limitations Act section (DMBM595080) "Tax credit overpayments ... are subject to the Limitations Act....



    1980 Section 5 "an action founded on simple contract shall not be brought after the expiration of six years from the date on which the cause of action accrued".
    Si i think i need to go through my files and find the paperwork!!

    This goes back to 2007 and i guess i have to dispute this. From what i can remember they put my salary down as a lot lower and im sure i informed them at the time as they reduced my payments accordingly,. I no longer claim and have had no dealings with them for 7 years. What do i do now?
    Obviously i have no evidence of any phone conversations.

  • I'm afraid I had a similiar situation, tried to fight it at the time the overpayment was claimed to have been made, but got no where. Then last year they started taking money from my tax credits.

    It seems like there is little you can do. If they did over pay tax credits and you did earn more than they had in their figures, they will say you should have corrected the figures. But you can suggest an amount you can afford to pay and pay it back slowly over time.

    Mine happened in 2008. I'll be paying it back for years. If they followed the rules, I shouldn't be paying it back at all but no one is listening.

    If it is genuine, i.e. only if you are 100% sure you were overpaid, offer to repay it at the rate of £10 a month and just set up a standing order for the repayment.
