I am at a stage in my claim for credit card charges that Barclaycard have put an acknowledgement and defence in against my claim
Barclays have just sent a letter saying because of the test case they are asking the court to 'stay' my credit card charges claim
I thought this bank charges test case had nothing to do with credit card claims and the claim could continue
Is this right and do i have to explain this to the bank and the court
Please advise

I have just started claiming my credit card charges back, asked for £1265 in total charges. Barclaycard replied crediting my card with £469.
They say that this is the difference between the charges then and the £12 charge they apply now.
Can i not get the total ammount of charges back or is it just the difference between the too!!!
Very confused, HELP please. x

smithies, the bank charges case has no effect on credit cards, you need to dispute the application.
parober3, I pressed ahead for the rest against Capital One and got it without going to court. You should be able to claim the rest back, although there are no certainties in life.0 -

You can accept this offer but i didnt and went to the next step in the form of a letter as follows:
Dear Sirs
Account No:
Thank you for your letter dated xth xxxx 2007 offering a goodwill gesture of £xxx.
However, I am disappointed that you have not agreed to refund the full charges on my account in relation to late payments and over limit fees despite the fact that they are unlawful at common law under statute and under recent consumer regulations.
I therefore require a full refund of the charges within the next 7 days or I will start legal proceedings.
Yours faithfully
Hope this helps

I rang the FOS last week and they confirmed that the test case will not affect pending credit card complaints. Stick with it, they're trying it on.0 -
Thanks
I'll write to them both and get it sorted0
