parking charge

I took my elderly sister to asda, to do her weekly shop.all the disabled bays were full so I had to park in a bay. I picked an end bay because I needed the extra room to get my sister out of the passenger side, as she needs the shopping trolley to use as a walking aid. the car next to me was on to the white line to my passenger side. but on the right side of my parking area, was no white line, just a bit of pavement or concrete extention of the bay.with no more bays after mine. I had to leave the car there as the car park was very busy, and I couldn't leave my sister on her own. when we came back I had a parking notice on my windscreen. saying," not parked correctly within the markings of the bay or space."

    Have a look at the newbies sticky to see your various options for seeing them-off.

    As your sister is disabled, a strong complaint to the store about their failing to respect the provisions of the Equality Act is probably your first/best option. :)

    Do not pay, do not ignore, do not reveal who was driving, do not 'phone a private parking company, ever.


    Read the Sticky thread for NEWBIES and appeal using the template letter in post 1 around day 22. Do not edit it in any way.


    Meanwhile, complain to the store where you visited and instruct them, calmly but firmly, to cancel the ticket. State that one of the passengers was disabled and if necessary quote the Equality Act 2010 applies. You will need to read up which bits are relevant.
    Don't miss the appeal deadline, and don't assume everything will be fixed by ASDA even if they promise to sort it out. Another poster on here tried and failed to get their ticket cancelled by ASDA so they can't be relied upon to help.


    Rude comments on Fakebook, Tripadvisor, and [EMAIL="Tw@tter"]Tw@tter[/EMAIL] are options to you as well if you feel so inclined.

    I'm assuming this is a charge from Smart Parking.

    Go back to Asda and demand to speak to the manager ( or duty manager ) and DEMAND firmly but politely that they get the charge cancelled. DO NOT let them fob you off that they don't own the car park. Smart have been contracted by Asda and so it IS Asda's problem ( oh, and they WILL own the car park anyway ).

  • Thank you for your answers. the ticket was issued by ukpc on middlebrook retail park in horwich. Asda is just one of about 30 shops on the complex. the car car park is just one big area, not separated from each shop. I followed newbie instructions and went to the asda shop were I was shopping when ticket was stuck on windscreen. They told me the land is owned by emmersons , and I must see them. I went to their office on the retail park and was told to wait outside for someone to see me. low and behold it was a ukpc attendant. I showed him were I was when the ticket was given,and he told me to appeal to ukpc. whats my next move please.?. thanks again joe.

  • Thanks again for the replies. I am going to follow the procedure as advised by the forum. Just as an afterthought, would it be any use writing to asda (who say they don't own the land). stating the fact that all the disabled bays were full, and I have proof of blue badge, which I could send them. joe

    tom - you DO tell Asda firmly, politely, that their agent has done this in their name, on their instruction.

    If Asda engaged them, Asda control and instruct them.

    [An aside: 'must' is not a word for them to you. It IS a word from you to them.]

    Did this humanoid declare itself to be the landowner?

    Did you challenge his authority to speak for the landholder/owner?

    What contemporaneous unredacted docs were shown to you proving this authority?

    You could claim that the photo had been taken from a bad angle and had been doctored and quote today's Daily Mail.
  • Sent of my template letter 22 sept 15. online. got a reply by post dated 24/sept/15. but I only received it 5/0ct/15. they rejected my appeal. on the parking charge pinned to my windscreen on 4/9/15. was the car make and reg. ( my car is silver, but on the ticket it said gold). on the rejection letter, it gives me an option to pay, or make an appeal to popla. what do I do next please.
