Hi, came on for some advice. Sold a ring on ebay and posted shortly after sale. The buyer contacted me after 7 days saying it was late waited another few days and because it was tracked and the RM website did not show it as delivered I refunded the buyer. After the refund I contacted Royal Mail to seek some redress for the item, and the sent me a letter showing the buyers signature and that it had been delivered to her address. I contacted the buyer sent photos of the letter and she is saying that this has happened before and someone else is signing for parcels that she did not get it. I rang ebay and they more or less told me to sort it out with the buyer but the buyer is being uncooperative. Can I open a case in paypal for this. If this is happening as far as I am concerned the buyer should not be bidding for anything until its sorted and I was foolish for refunding when the buyer had not opened a case, nevertheless I should not be out the price of the ring as she says she hasn't got it and can't return it,I would like the money for it.

    I think you've been scammed.

    Unfortunately if you sent it Registered (Recorded) rather than Special Delivery Royal Mail often will not show final delivery.

    Too be honest, I believe the buyer has the item, and a scamming you. Ebay or Paypal cannot assist they are there to protect buyers, not sellers, so you only course of action is civil recovery (a small claim via MoneyClaim)

    Your mistake was not to get the buyer to open a Case, as you might have had a chance of an appeal, but a refund outside of Ebay resolution will never be reversed.

    First off check to see if the buyer is on facebook and there's any photos of the ring being worn, do this straight away and grab screen shots of any images incase they remove the photos.

    and contact any other sellers of similar items or where the buyer has either left them feedback indicating a problem or no feedback at all.

    You can ask Royal Mail for the GPS location of the PDA at the point of delivery, you could also phone the buyers depot, ask for the manager, explain the situation and see if the postman remembers delivering the parcel.

    You can send the buyer a Paypal request for the money and advise them they have 7 days to pay before you issue proceedings via the small claims court.

    If no payment you can send a recorded delivery "notice before action" to the buyer.

    Whether you wish to go further is up to you, if any other sellers do report problems with the buyer I would confront the buyer about this.

    I would also ask the buyer for the reference number from Royal Mail relating to her complaint that previous mail was not delivered so you can follow up on this as it's still occurring.

    You could also dispute the signature with Royal Mail, if you believe the buyer is lying then it's not Royal Mail's fault, if you believe they did deliver to the wrong place then pursue the claim.

    There are plenty of steps you can take depending upon how much effort you wish to put in.
