Highview Signs Grammer ?

My daughter got a ticket picked her friend up from the back of work on evening. It was dark at the time and see didn't notice the signs, plus her friend had said go round the back and wait, she was there 16mins according to the letter and photos from Highview.
I investigated and found the signs written in a way that they don't quite make sense or state the camera is used to issue tickets :undecided Wondering if it's worth an appeal ?
The sign states;
"By entering this parking area/parking in this parking area you contract and consent to comply with these terms and conditions"
Along with no mention of using the ANPR for parking fines !
"The automatic number plate recogniton (ANPR) cameras in this car park are used for the prevention and/or detection of crime, and the Data collected may be shared with third parties for these purposes"

umm ,
1: anpr cameras take single pictures , they are not CCTV
2: by entering the carpark you are (supposedly) entering into a contract , what crime has been committed at this point?
Data collected may be shared with third parties for these purposes"
I thought you had to do a "tick" on a form , or sign that you were allowing your info to be passed to other companies

It does not state what the actual "terms and conditions" are. What part of "A whop bop-a-lu a whop bam boo" don't you understand?0

"this car is for permit holders only"
I have a permit to park in my companies car park 300 miles away , does this count?
in fact write back to them saying you have a permit , let them tease out of you that its a permit for keeping a dog or a weird animal or even a council parking permit .
enclose there photo and ask WHERE does it state a permit for THIS carpark?0 -
Just like the equally stupid PE notices which say "Blue Badge Holders only in disabled bays". You could read that as implying that if you have a blue badge and all the disabled bays are full then you can't park anywhere else in the car park. What part of "A whop bop-a-lu a whop bam boo" don't you understand?0

The usual nonsense of attempting to mix trespass and breach of contract.
The sign makes it abundantly clear that the only people permitted to use the car park are permit holders. This renders all others trespassers. Not content with that Highview then attempt to offer a contract for those trespassers to stay. A legal nonsense.
You cannot contract to do something you are otherwise not permitted to do.My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016).
For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com0 -
