ESA Appeal logged - But Contribution-based ESA expires soon

Advice please!
I have just lodged an appeal with HMCTS for my ESA claim as have been found 'fit for work'. I went onto JSA for the last month, even tho I have been signed off sick by my doctor, but have now asked for my ESA to be reinstated whilst appealing.
Problem is, my contribution-based ESA expires very soon. What should I do? Should I then claim income-based until my appeal is heard?
I'm also due to have a minor op procedure in a few weeks (something medically separate from my original ESA claim) and in the advice leaflet, it says you'll be off work for 1-3 weeks. So where does that leave me in terms of claiming ESA again?

If you are entitled to income-based, then it would not be a new claim.
It would be a simple form to tell them you have no assets over 16K/income.0 -
It's only that simple if the claimant is single. Income Related benefit is based on household income so full details of any partner would also be required, if there is one. Assuming your ESA claim is reinstated pending the appeal you will need to let them know you want to claim Income Related benefit and they will send you an ESA3 to complete.0
