Quick ? about probate

Hi All, my dear dad passed away at the end of April, the whole estate was left to me with Family Solicitor acting as the Executor. Probate has now been granted but how long does it take for monies to come in from the Bank Accounts? I have asked Solicitor for an advance as my finances are dire at the moment and he says as soon as mony comes in he will.
Answers would be much appreciated.

Sorry to hear about your loss.

It is a bad idea to have a solicitor as an executor as they take forever and charge high fees. Most of the work involved in being an executor is basic admin and does not require professional legal skills.

If you consider yourself to be reasonably competent in admin you should consider taking over as executor. A solicitor (i.e. another solicitor) should be able to advise you on how to get the executor-ship off the lazy greedy-guts solicitor.

Hi thanks for that advice-I know the fee business, but solicitor was named as executor by dad in the will so I cant get out of it, or at least I dont think I can.
The charges I have already been advised..... no more than £3300. I nearly dropped off myself.

There's no reason why the solicitor can't give you a good estimate of when the money will be released. 'Soon' doesn't sound very professional.
The fees may be high, but if your dad wanted the solicitor to execute his will - that's what he wanted, and he would have his own reasons for that.
If all the estate is money, it can be settled quite quickly after the grant of probate. HTH
.................:)....I'm smiling because I have no idea what's going on ...:)

Hi Errata, there is a house involved too. The Solicitor is letting me sort most things out myself-dealing with Estate Agents etc, thats why I have asked for an advance on monies.
  • Just wanted to say my gran died july the 4th last year she didnt have much her house was her main asset small pension etc she had no will and seven children they took on a solicitor my mother and her brother are dealing with it through the solicitor with the agreement of their siblings.

It still is not sorted out they all had an interim payment of 5k about 8 weeks ago but solicitors drag their heels something terrible and theirs is charging a fortune.

My deepest sympathies for your loss
