I received a lovely charge from UKCPS, I wrote back asking for evidence of the Driver/passenger leaving the site and stating they would get nothing from me. I appealed the charge through the "independent" appeals service and of course the appeal was dismissed.
However the evidence that UKCPS provided to IAS included a note from the "warden" stating some information about the driver, where they were heading and what they had with them... the description is not of me nor anyone I know. So what next? Or do I just await my day in court?

Driver-stalking, was he/she? Sounds like fishing for details, if you rebut.

Up to now AFAIK no IAS appealed case has progressed to court.....
so you are in the wait for up to 6 years to see if they change there approach to such things......
we would appreciate if you would kindly post up the IAS reason for refusal ....
two reasons ...
1 it gives us a good laugh ...:D
2 a compilation of baffling decisions are being collated ..... for the day of reckoning;)

So you have a statement from the Warden admitting that they failed to mitigate any loss, by simply standing by and doing nothing?
They won't want that in a courtroom.Je Suis Cecil.0 -

This company appears to have a problem with v.a.t.
If this is contractual charge, as they claim, it is a fee for parking, on which v.a.t. is payable. Have they accounted for vat on their paper work?
If vat is not mentioned it becomes damages for breach of contract . No vat is payable but it can only be enough to compensate them for losses arising from the breach, and GPEOL applies, Ask then for a vat invoice. If they ignore, (which they probably will), it is a useful stick with which to beat them if it gets to court.
