Think yourself lucky....in the early days of my BR a few years ago the OR's office decided to send me correspondance with "insolvency service" stamped all over the envelope...meaning the postie and anyone else in the house could see it for all

This still happens, and the postman is an ex colleague and the village gossip! I also had one addressed to 'Mrs EJ Bloggs(BANKRUPT)' (Their capitals, not mine)from somewhere else. I was able to stop that from happening again with a sharply worded letter. However the main thing about being bankrupt for me has been the complete lack of confidentiality, as I've said before, my Gazette entry comes up on the first page of google to anyone looking for perhaps my postcode or to check my address. (I work from home so this is likely to happen a fair bit) Google couldn't stop it, nor would the IS or the Gazette - apparently we're fair game and our info is not just available to anyone who bothers to actually look me up on the Gazette's website, which is what I had thought. I'm terrified my grandchildren will see it, I've only told one person but am aware ex work colleagues know (and titter in a shocked fashion behind my back!!) In the old pre-internet days, people did actively have to look us up, and how many would bother to do that in an idle moment?

I am really also shocked that your personal information was discussed with your son, - or anyone for that matter. Surely we're entitled to some dignity even if he and his friends might waste time googling us on the internet. It should be up to us how and when (and if) we tell family and friends. We'll be going round with 'unclean - unclean' on a placard round our necks next.

This has made me really angry, I so feel for you! XXX
  • Slightly annoying and clearly unprofessional but not really the end of the world or cause for a compensation claim.

At the end of the day, it was the OP's 15yo son i.e. a member of the immediate family who lives at the same address who presumably knows about the bankruptcy issues anyway.

And of course the OP's bankruptcy is quite rightly a permanent matter of public record. As previous poster have stated, the social impact of this public record depends on where the OP lives and how interested friends/neighbours/villagers are etc.
  • I am quite shocked to read the lack of confidentially going on. Brock I do not discuss financial matters like that with my son, he has enough to worry about being a teenager and exams. ( I also made no mention of compensation. Bankrupsy is a complicated matter and would be hard for a young person to grasp. Elljay exactly should be our choice who we confide in. I have been told by several people this is not a punishment but that cow I spoke to yesterday certainly made me feel it was Luckily I have been assigned a different person and he is proving to be really great, has even emailed my current bank to say they have no objections to me keeping the account going which is really helpful.
  • Even if the OR has said to your bank they are happy for you to continue using the account it does not mean the bank will allow you to keep the account.
I was lucky my bank allowed me to keep my account after the OR giving me a letter saying they had no problem with me using the account.
The letter the OR give me for the bank had about six lines and referred to me as the bankrupt on each and every line just in case I forgot I was bankrupt so you just have to accept bankruptcy for what it is and keep moving forward.
  • Agree with you completely. Your son shouldn't have been told. My OR has been extremely professional and courteous and helpful. I told him they I hadn't told my landlord yet as my OH pays the rent for the family home and he said not to as the OR will not be informing my landlord

Separately, even if you have a letter of support from OR regarding your bank account, your bank may close your account as a matter of their policy anyway
  • Well an update. Finally managed to get my personal bank account up an running, business account is closed. I am running a sole trader business from home and OR aware of this but going to have to use my personal account for business purposes as have no choice. Was told earlier that the bank will not be happy with this but what choice do I have.

  • Thanks Tiger, just filled out the form and waiting for someone to get back to me. Looks good.
  • Another question, does OR have access to me bank account. I worry as have quite a bit of money coming in this month, but very little likely to come in for a few months, this is how my business is.
