Still waiting on a written acceptance two weeks later?! (Scotland)

Hi everyone - first time here! I am looking for some advice. We had an offer verbally accepted on 17th August. To date we are still waiting on a written acceptance from the seller.


It is a chain free property in that it had been rented out by the seller and is now sitting empty. We are FTB so no chain our side either. After the offer was verbally accepted, the seller solicitor contacted ours to say they had received the offer and would like to progress as soon as possible....that was two weeks ago and still no written acceptance?!


The offer we made was very basic and left the date of entry and moveables both open for negotiation so it's not as if there are lots of clauses to discuss.


Further to this, the Estate Agent still has the property listed online and hasn't marked it 'under offer'. I called them to ask about this and was advised that it is not their policy to mark anything as under offer or Sold STC until the conclusion of missives - I think this is a load of rubbish!


We did receive an email back from the seller solicitor today saying we would hear from one of their solicitors shortly...


Any advice??

    Maybe seller and/or solicitor has been away on holiday? You can always threaten to start looking elsewhere if you don't get a response sharpish.
  • I'm in a similar situation - verbal acceptance in principle the same day the written one went in, which had a deadline of last Thursday for a formal written acceptance and I haven't heard a thing. In my case, I suspect it's probably because my solicitor is on holiday until next Wednesday, so I'm not too worried.

    The fact that the seller's solicitor is communicating is a good sign, I expect it's just people's holidays getting in the way. Now the schools are back, you might find things start moving.

    Do you have your actual mortgage offer in place?

    I was in similar circumstances, as I am in the process of being a house and we didn't receive a written acceptance until we had our mortgage offer....

    You keep mentioning "chains", but these don't exist in Scotland.

    Also the property is still just "under offer" so I wouldn't worry about that side of things.

    I wouldn't stress too much, but your solicitor Gould be chasing this and advising if there is a reason why the written acceptance hasn't been received yet. Don't email them, phone them.

    Could also be something dull like the solicitor still waiting for the title deeds from a lender (which they would want to check before answering some of the clauses in your offer).

    Has your solicitor sent a written offer to their agent or solicitor?

    I wouldn't expect to get a written acceptance until that has been done.

    I am in the same situation, offer was verbally accepted 11 days ago on the proviso my solicitor faxed the offer over and we have heard nothing back in the written acceptance front.

    Not worried but I would have thought that they would have wanted to tie up the deal quickly.

    Yes we have our formal mortgage offer. The seller solicitor received our written offer on 17th August. By a chain I mean we aren't trying to sell our property and the seller isn't waiting to buy somewhere either?


    My solicitor forwarded an email trail to me yesterday and in it the seller solicitor 'acknowledges' a date of entry of 2nd October - this wasn't included in our offer - I am happy enough with this date but it didn't come from us and they still haven't sent a written acceptance. My solicitor has suggested that this must be the date they are proposing but it seems like crossed wires somewhere along the line!


    Further to that, within the emails my solicitor was asking for a copy of the home report, to which the seller solicitor responds they are waiting for it coming from the estate agents. This is infuriating as I've had a copy the whole time if anyone had thought to ask me!


    I am such a control freak I can't stand all this waiting!
