Notice query

Hi

Potentially buying a house (waiting on mortgage/searches).

Currently we are in rented accommodation on a one year contract with the 6 month break (8 months into it at the moment). In the contract it states that 2 months notice is required. I begrudgingly accepted this as we were in a tight spot and needed a place quickly.

We would only need 1 month to move and sort everything and so month 2 is just chucking money away.

2 questions here:
Can they legally require 2 months notice? (Is it one of those terms that can't be changed even if in a contract (like a 6 month break))

Is there anything preventing the landlord agreeing to 1 month if they had a tenant lined up quick enough? (Views on if landlord is likely to do this is also appreciated).

    Some LLs will be understanding & helpful, some will stick to the letter of what is legally requited.

    Giving informal advance warning to a generally friendly LL can help. Or at least help you find out what his attitude will be.

    Being very coopertaive with viewings by potential tenants can also help.

    The advice on this forum is NOT to give notice until contracts are exchanged. At which point, 2 months is far too much.
  • Yeah it's a fine line. We haven't found anywhere yet but have two months notice- we won't be waiting till contracts exchange to give notice though, we can't afford to pay rent and mortgage in the same month. We'll move in with my parents if needs be.

    Yeah. We probably have the option of parents too. But it's just so much effort moving twice in quick succession. We had to do that in feb this year!

    I keep telling myself it is new build so as long as the mortgage is fine it shouldn't be an issue. Most of the searches have been done. Just need the local one doing and then looking through the contracts.

    Landlord seems like a nice bloke. Might just have a chat with him and say would he try and get a tenant in within the first month. I can cooperate with him then for the viewings.
