If this continues, we will have to advise everyone that WH are a busted flush and withdraw their appeal, on the basis that WH, acting as PoPLA have lost credibility.
You never know how far you can go until you go too far.
  • Been there done that TD.

There has been a lot of confusion here by the OP as he has been emailing POPLA, as he didn't realise he was dealing with WHOPLA.

Yes this was a tesco car park.

Hopefully I've removed all my personal details:

Originally I was dealing with POPLA, where I "won" my appeal.

But the once they re-opened it I submitted more evidence and sighted the Bevis case and then it was put on hold before moving to WHOPLA.

Well the NTK, ("charge notice"), fails to identify the creditor, there's no date of posting and the wording to make the RK liable after 28 days is missing; so WHOPLA are wrong.

Thanks for posting up the NtK. I'll go through when I have more time over the next day or so (sorry, mad busy at the mo). Castle has identified two WHOPLA fails, add to that (from my quick glance-over) no duration of parking - 'from to'.

I guessed right with Tesco. Time to bang the manager hard with a full-blooded complaint and get him to cancel this. Escalate to HO if necessary.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
