VCS Ltd Disabled Bay

A family member recently received a PCN from VCS Ltd for parking in a disabled bay on a raod without displaying a blue badge. I have had experience with winning POPLA appeals in the past, but not with IAS. I have advised them not to pay, but they are a bit worried about the possibility of court, on the presumption that the IAS appeal will fail. I am not experienced in court and I am a bit worried that it may be hard to defend this type of case, i.e. parking in a disabled bay without displaying a blue badge. Does anyone have experience of this?

if it is I.A.S. the appeal is very likely to be disallowed, but not to worry, it will be anonymous, partial to the PPC, flawed, and not compliant with normal ADR guidelines, not worth an eggcup full of lukewarm urine.
They will also most likely be evading v.a.t..
Treasure it, and if they take you to court, show it to the judge and make his/her day.You never know how far you can go until you go too far.0 -

The PPC appeal will fail and the IAS will also fail .... unless you win this weeks lottery
After reading .... do the first appeal .... do some more reading then consider the second appeal ...

where was this? SA1 area of Swansea.
was it on a public road? As far as I know, no. I think BP own the land which now has flats/bars on it.0 -
The possession of a blue badge doesn't mean a lot, especialy on private land.
However the Question of why he/she parked in a disabled bay may yield more appropriate answers. and as a result better advice on how to fight the parking ticket

Parent and todler bays occupied?
only nipping into the shops for a short time?
Whilst parking in disabled bays without reason should never be condoned ( it gives the PPcs some oxygen to justify their existence ) Parasitic Parking company's (PPCs) are, in my opinion a greater menace than the abuse of disabled parking spacesFrom the Plain Language Commission:

Why did they park in a disabled space? Was driving to a music gig and initially parked to unload the gear but technical difficulties caused a delay.
Disability but no BB? Not officially disabled no, but does have limitations due to age which can be medically proven. I'm not making excuses though, not disabled.
poor marking/signage? Signage is high up and not lit, but the bay has large disabled signs painted around it.
no where else to park? No, the whole area is covered by PPCs
Parent and todler bays occupied? Not applicable.

Current experience is that no case that has had an appeal turned down by IAS has yet got to court. But maybe that could change.
Some regulars on here believe that the normal IAS rejection to one of the forum recommended appeal points - see NEWBIES sticky thread at top of forum - is so biased towards the PPC that neither the PPC, IPC or IAS would want to expose this to a court.
But things change and there are no guarantees from anyone here, only best info from current experience.0
