If any driver has received a PCN from Smart Parking in this car park then this is important. SMART PARKING are breaching the British Parking Association's Codes of Practice by not offering 10 minutes grace period before or after the time on your ticket. Please share with all your family and friends on facebook if you or they use this carpark. In fact it would be good if all drivers who received a PCN got together and took SMART PARKING to court to get their fine plus costs back,.0

More importantly, this car park is in Scotland so the best advice is to complain to the landowner, tell them you will never visit there again as long as it is infested by Not-so-Smart, and ignore the parking company.
Ignore anything and everything you get from them, and debt collectors. Ignore, ignore some more, then after 5 years, ignore it for the rest of your life.
The POFA 2012 does not exist in Scotland (and Norn Iron) so the keeper cannot be held liable. Never ever reveal who was driving, and nothing bad will happen.
Do not, repeat, DO NOT contact the parking company, ever, in Scotland or NI.
By the way, it is not a fine, and the grace period before parking is not ten minutes. There is no time limit specified in the BPA CoP, just that there must be one. The grace period after the parking period has ended must be at least ten minutes.I married my cousin. And you are posting against the rules on hijacking threads you clearly agreed to here!
And the advice in the post above is the most viable for Scotland - simply IGNORE the bams!0 -
Hello, I am sorry if I am going over old ground
Both myself and parter used the car park and "overstayed paid time" I am not clear exactly for how long, but not more than about 15-20 mins.
Smart parking have been sending letters - with photo evidence of us both leaving car park.
As per advice have been tearing up - now got the zenith letter
Does the photo evidence make their status more relevant or do I just ignore until I get a court letter - and then what?
Cheers and apologies if I am asking same questions - but had not seen anything about photo evidence, and wanted to see if this made any difference.

Please don't jump in on another person's thread. But in any case if you're in Scotland the advice is to ignore this. Simple as that - IGNORE (and any subsequent debt collectors letters, with or without photos). No need to respond here - just IGNORE.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

I hope the newspaper tells everyone to ignore the scammers and avoid the car park. That's all that needs to happen in Scotland. Engaging with the scammers is totally unproductive and may give away the driver's details which is the last thing anyone should be doing.I married my cousin.
