PCN with incorrect car park name/address

    Hmm
    Was having my quick daily look at the UKPC website at my ticket number & odd things happened
    I entered that I wished to make an appeal as this seems to be the only place to track what is happening & rather than pop up to tell my it was on hold pending my previous appeal, it allowed me to start a new appeal. Slightly panicking, thinking they had cottoned on to where the car was actually parked, I went to look at the pictures & they are still there. Panicking a bit more, I went to the lodge an appeal page again & it said THANK YOU, Parking Charge has been cancelled in full. This is now what comes up every time I enter my ticket number
    RESULT :j
    However, still not received anything official from UKPC yet so the cynic in me says a new PCN with the correct car park name could drop through the door this week. Let's see

    Hold on to any paperwork you've received from UKPC, don't just throw it away in the belief that it's all over. In fact I would recommend filing all the paperwork safely for the next six years (the time limit within which a court claim can by instigated, until barred by statute at the six year point).

    Only thing I have from UKPC so far is the incorrect NTD attached to the windscreen which is filed along with a copy of what I wrote in the appeal & screenshots of two pages in their website saying charge has been cancelled in full
    Yesterday was day 19 so will be interesting to see what if anything comes through the post. If I get an NTK over the next couple of days due to my foolish newbie information on the appeal then they have clearly not followed the correct process in getting my details so it will get another rebuttal

    Fire off a complaint to the DVLA and BPA (separately) - they have no right to request your personal data for a parking event that didn't happen (you can prove you weren't in the car park mentioned, you don't need to tell them that you were parked in a different car park*). I'm sure it'd be a breach of the Data Protection Act too.

    It'll be brushed under the carpet with the rest of them, but you should be making as much noise as you can.

    *"I recieved a parking invoice for a car park in which I hadn't used. This is surely a serious breach of the Data Protection Act".

    Like I said, I've not had anything other than the NTD attached to the windscreen with the incorrect location so can't really fire off any complaints yet. It pains me to say, but UKPC have followed the rules so far. Just have to wait if anything else appears & if it does, I'll delve into my arsenal of complaints & technicalities.
  • Well this tipped up in the post this morning so it looks like the charge has been legitimately cleared. However, is it me, or is the second paragraph relating to POFA written like a veiled threat to me as the Keeper? I'm taking particular exception to the bracketed conclusion which says they consider they comply with the Act "to the letter"
    To recap, the incident was 21/08/15 & I made the appeal on the same day as Registered Keeper (which I now know was wrong in terms of timings). This letter is addressed to me insinuating Keeper Liability but dated 08/09/15 which is 18 days from the day after the event so at this stage they have clearly not complied with POFA
    It really annoys me that bottom feeding scumbags like this company try to extort monies by wording letters in a threatening manner supposing legal compliance in the hope the victim will pay up, if not in this instance but in the future


    Dear Mr
    Thank you for your recent correspondence in relation to the above Parking Charge. We understand your frustration and appreciate the inconvenience this has caused you. It is not our intention to cause undue worry and frustration when enforcing our clients parking regulations.

    Paragraph 9(2)(b) of schedule 4 of the Protection of Freedoms Act 2012, states that we must inform the registered keeper that the driver of a vehicle is required to pay the parking charge in full. It also notes that as we do not know the driver’s name or current postal address, the registered keeper, if they were not the driver at the time, should inform the operator (i.e. us) of the name and current address of the driver and pass the notice to them.
    The Act also warns that if, at the end of the period of 28 days (beginning with the day after the Parking Charge is sent), the parking charge has not been paid in full and the operator does not know both the name and current address of the driver, the operator has the right to recover any unpaid part of the parking charge from the registered keeper. This warning is given under Paragraph 9(2)(f) of Schedule 4 of the Act (which we consider we do comply with, to the letter)

    We have investigated the appeal based on the information submitted by yourself and can confirm in this instance that the Parking Charge has been cancelled due to an administration error.

    In future please ensure your vehicle is parked correctly within the markings of the bay as clearly stipulated on the signage one of which was in clear view of your vehicle. Failure to do so will lead to further parking charges.

    Yes his type of tripe gets up my nose too, similar to the clime down I had recently from UKPC, it makes you want to write back and tear the upstarts to bits.
    Just swallow your pride and revel in the fact that you have beat these slimeballs what ever garbage they spout back.

    I was visiting a property that I own & got a PCM (Cowboy) Parking charge notice for 'not displaying a valid permit'., even though I displayed a note saying that I was the Landlord & owned the property.

    Having looked at the Newbie PCN advice, I plan not to do anything until 21 days when I may lodge an appeal.

    However, I have just noticed that the site location is Incorrect & that no such location exists (at least, not in my area) !

    Does this error negate the enforceability of the PCN, meaning that I can just ignore it ?
