2.5 years wait with FOS. Help

I have a case against RBS credit cards. Initially they were going to pay out, however at the last minute they contested the payout. At the time this case had been with FOS for about 3 months. This was then referred to another ombudsman for adjudication. Now a new court ruling has been set and this is going to delay payouts. I have been waiting two and a half years for the FOS to get an outcome for us. I have been phoning them monthly over the last 2 years and I am being constantly being told that it is with the right department and we can't give you a timescale for completion. This is so frustrating!!! Can anyone offer us any advice on what to do next?

    Now a new court ruling has been set and this is going to delay payouts.

    The ombudsman doesnt use courts and there are no court actions planned. If there was, then everyone's decisions would be suspended pending outcome. Not just yours.

    Ask the FOS what court case as its strange that yours is being held because of this when no-one else is.

    I’ve been in touch with my colleague who has explained that your case is currently with a team to review whether the recent supreme court ruling will affect it. If it does then it is likely that you will be waiting longer for answer. However the team will be in touch with you to explain in more detail what will happen and why once your case has been reviewed.

    I’m sorry I can’t give you any timeframes for how long things will take from here or any more of a specific update. We are aware that your case is very old so it will be amongst the first cases to be worked. on

    Good morning Margaret. Can you let me know if you have received an update from your colleague about the possible escalation of my case against RBS? It is so stressful not knowing what is happening two and a half years later and we are caring for my mum who has Alzheimer's. I appreciate your support in this matter.

    I wondered if it was plevin but didnt realise that was a supreme court case. What is does tell us is that the compliant has been effectively rejected on all other points if they are waiting for the outcome of that. (as any other point would see them uphold the complaint without the need for a wait)

    Plevin involved a broker using a third party product with a lender. Whilst it is impossible to know the outcome of the review following that decision, it should be noted that in this case, there was no broker and no third party product. It was own brand. So, I wouldnt get your hopes up. It is still possible you could succeed as the legal position on other areas is not known. Just be prepared for rejection.
