PPI Claim

I have got Charter House Claims dealing with my PPI claim. This has been going on since February 2015. After hounding me to send back the signed consent forms I have had little contact. Don't know if I have a Claim with any of the Lenders. If I ring they say they have a chase on the Lender. Is this normal to be this long and why cant they tell me if I actually had a any PPI when they got the original agreements back from the Lenders. I would really like to know as I am facing redundancy and a little extra money would really help me at the moment.

  • I believe that if they had put a claim in, you would have got an acknowledgement letter as well.
    You certainly should have had something by now, even if to say no PPI.

    Sadly i believe most of these firms have clauses that say you must still pay them even if you put a claim in yourself now, do all the work and are successful.

    The experts here may be able to clarify this, but that appears to be the general response when this question has been asked before.

    Sounds like the CMC is dragging their feet over your PPI complaint, my cousin is experiencing a similar situation, not receiving acknowledgements or updates, wrong forms being sent out, delays in responding to lenders, breaching the eight week deadline etc and if you are eventually successful they'll take at least a third of any redress you're awarded.


    All you can do now is keep on top of them by phoning every week, he who shouts loudest.

    Sounds like typical CMC nonsense, call you out of the blue, promise the world and deliver nothing.

    It's not rocket science, most lenders these days have a system in place for responding promptly to enquiries regarding whether someone actually has PPI and it certainly shouldn't take 6 months. However, even if they find out whether you had PPI, that doesn't mean that there are grounds for complaint with regards to it. Only you can tell them whether that is the case.

    Sadly, the previous post is correct, generally speaking even if you complain yourself and obtain an offer, they will still expect their cut. Their standard terms & conditions (see http://www.charterhouseclaims.com/landing/terms.php section 11.3) indicate that for any early cancellation, a fee of £60 per hour will be charged. This looks designed to put people like you off from cancelling - let's face it, who wants to cancel and do it themselves when you are likely to be charged a ridiculous fee for the "service" to date when there is no guarantee you would even get anything by doing it yourself.

    If you're up for a fight you could make a complaint to them stating that their service has been unacceptable and you wish to cancel the contract without charge. Then threaten to refer the matter to the legal ombudsman if they won't play ball. But I appreciate this may seem like a lot of hassle for possibly little reward.

    Ironically, this uses a process almost identical to the one with FOS that they are relying on.

    Put in the complaint, wait eight weeks or until they respond. If you are not happy with the response - or they do not respond within eight weeks then you go to the Legal Ombudsman rather than FOS.

    All fairly easy and straightforward.
  • Please could anyone advise me, could you have a claim for miss sold PPI on store cards, notably a Time Card from Comet and a Mothercare store card.

    equally we cannot find the details for these would that be a problem or something that we can work around?

    If either of those store cards were sold before 2005 they were't regulated.
    Time no longer exists so you have no one to complain to.
    Santander took over most store cards, so find out if they are servicing Mothercare ones. Again though, if it was sold prior to 2005 they weren't regulated.

    I presume that by not regulated therefore you mean they have no accountability.

    and would it be to far fetched to imagine that someone bought the Time accounts and therefore the responsibility? would the kingfisher group be responsible as the card was set up via Comet?

  • Comet and Kingfisher demerged and became separate companies in 2003. As stated above this predated regulation so it's unlikely you will get anywhere with Kingfisher.

    Have a loan with ppl (firstplus) through a broker. I claimed against the broker and was successful but part of the "settlement" with them was that I had to go through Firstplus to reschedule the loan as if no ppi had been added. They refused. Where do I stand / what should I do next?
