A little advive POPLA

I have just received an evidence pack and the Parking company involved has stated that to POPLA "Please note we do not supply a genuine pre-estimate of loss as"


does this mean that GPEOL of point is invalid?


also if POPLA rules against me am I in a different position as before I applied? for example do I now officially have to pay or can I still hold out for the stamped letters?

    It would mean their GPEOL statement is invalid, assuming they are claiming the invoice is for breach of contract.

    If POPLA find against you, then you're exactly where you were before, it's only binding on the PPC.

    #1 I assume you have also said 'no landowner authority' and Ethical haven't bothered to include the contract from the landowner?

    #2 And you'll hopefully also have a paragraph along the lines: ' I am the keeper and the Notice to Keeper (if any was posted to you) is not compliant with the POFA 2012 because...'

    Either of the above appeal grounds is likely to win at POPLA v Ethical. They are a joke! Ex-clamper idiots with their shed of a 'Head Office' in Worthing (where they used to store the cars, their ill-gotten gains from clamping and towing vehicles before it was sussed that was criminal).

    Your point about 'no GPEOL' will simply cause the appeal to be stayed until November as it depends on the Beavis case outcome. At least it means you won't lose in the meantime but no-one should ever lose v Ethical at POPLA! You can't lose this one, come on, Ethical are useless and you are better than them and you are here on MSE.

    Add the two first points in your rebuttal if you have not done so already. Email POPLA to add stuff (obviously point #2 won't apply if your first appeal admitted who was driving, you can't use the POFA if the driver has been admitted - hope not?).
