Business mobile contract: business dissolved; now what?

    You need to refer to the terms of your contract. Death or bankruptcy are the only circumstances that void a consumer contract without penalty, so in the case of a business contract it's unlikely that voluntarily closing the business (as opposed to the business going under) will allow you to escape the ETC.
    You really need to speak to Voda to see what the options are.

    Any update on this?

    I have a friend in a similar situation, took out a 24 month business contract with o2... and is wanting to close/dissolve the business 4 months in.

    Friend has contacted o2 as was willing to just transfer the contract from business to personal, but o2 appear to be making this awkward - they're saying this can only be done after 12 months, which would mean keeping the business running for another 8 months vs just transferring the contract to personal and dissolving it straight away.

    The alternative is of course early termination of the contract, but friend is looking at upwards of £800+.

    Would be interesting to know what happened with you and Vodaphone?

    I'm surprised you have been able to dissolve your ltd company with a debit/money owed to Vodaphone... I'm very surprised they didn't object during the 3 month closing process.

    OP is presumably still paying the DD-Voda will have no idea that the business has been wound up.

  • You must decide the contracts and the time you will make them run. The penalty will be changed, and it can only be voided in case of bankruptcy.

    Thanks for your posts. I've had mixed input from Vodafone and have called on several different occasions to be told different things. Firstly I was told that there might be a way to make my bills lower for the remainder of the contract - I would have to be in arrears and speak to their collections department. I did this and explained my situation, including the company closure, and the lady on the phone couldn't do anything and said that I should never have been told that in the first place. I needed to pay £400 up front now, or arrange a payment agreement. I called back again and was told that the company has a department handling company closures so I have been forwarded to them and will keep you updated.

    It really depends on the type of business. With a Ltd company, the debt dies with the firm. Partnerships or sole trader will be pursued in the name of the individual who signed the contract, and affects their credit rating.
