Parking ticket mcdonals

I was issued a parking ticket in Mcdonalds whilst using their restaurant. I had my Aunt in the car at the time who is a blue badge holder but i didn't think to display her badge as i was stressed that the car park was that full as i had just passed my test. I parked in the disabled bay but was flustered by how full the car park was and my aunt needed to use the rest room so i was stressed out. I purchased some food from Mcdonalds whilst my aunt used the toilet. I must have been there 4 minutes at the most and came out to a parking ticket. I have complained to Mcdonalds and am waiting for their response. What i am worried about is that my Aunt is my girlfriends aunt (who was in the car) but how can i prove she was in the car?

    its a moot point anyway

    if your complaint to micky dees works, its game over and the PPC should cancel the invoice

    if they dont, wait until you get an NTK in the post and appeal it following the advice and template letter in the NEWBIES sticky thread

    bear in mind that the BB isnt relevant on private land, but the EA2010 is, so it is this point you should use in your complaint to the retailer
  • you do not have to prove anything , the Burdon is on them


    we can probably guess , but who was the parking Co , was it an actual wardon in a full uniform , or perhaps a member of Mc craps staff

    You don't need to. You can provide her statement if it comes to it, but can they prove that no-one in the car required assistance?

    In any case, there was no loss, so the charge is not valid. Just appeal on the usual points from the newbies thread, and also state that one of the passengers is a valid BB holder.

    Anyway, Mcdonalds should cancel it with sufficient pressure. You should also point out that whoever put the ticket on the car must have watched your Aunt leave the car, waited for you to be out of line of sight and then pounced with the ticket - i.e. it's totally predatory.

    Find out the parking companies trade body and complain to them as well.

    Cheers, I have the NTK as it was from July the 4th but i have been on holiday. I phoned McDonalds today and they said they will get back to me. I asked the person who was on the car orders where the UKPC person was so i could speak to them, but she wouldn't tell me. It is UKPC who is the issuer. The other thing what annoyed me is that there were cars parked 'illegally' everywhere, that was the last space but he wouldn't go and challenge them when the people where inside waiting for relatives. I have read about the BB being not valid on private land which i was aware of, but still confused over it. I myself have a back problem called scheuermann's disease which i have to do physio for so i could possibly be eligible under the EA2010 if that is the case. Thanks for all the speedy responses everyone it has calmed my nerves down as i really don't have any money to pay this either. The other annoying thing is that they will have been taking up a car parking space aswell, stopping people parking as there is nowhere else to park.

    if its that old you need to send UKPC the template appeal asap, adding that an occupant of the vehicle was a BB holder and you will send them proof of this if they require it

    also tell them that as RK (not driver) you have also complained to McDonalds and you expect a cancellation forthwith

    the EA2010 is valid for these private spaces, but as its private land there is nothing "illegal" about it, its an unregulated industry, and its a civil matter, not criminal matter

    hopefully McD will cancel it and then its job done , but get that appeal to the NTK in anyway (if its a postal NTK and not the windscreen ticket)

    Do i send all of the template letter a - e and also the formal challenge and drop hands bit?
    f) A passenger of the car is a registered blue badge holder and as notice to keeper I also have a spine condition (scheuermann's disease) which causes me frequent back pain.
    I have contacted McDonalds directly and expect the charge to be dropped

    remove the part about you, just keep in non-descript but add that proof can be sent if required , then add that to all of the template and send it all

    They'll be easy enough to find, just keep an eye on the disabled bays for someone shifty scurrying out of the background whenever someone enters the restaurant to check the badges. As you noticed, they are issued and away within a 4 minute visit.

    If you really wanted, you could record it as evidence of their predatory tactic.

    Contract law requires them to mitigate losses, so if they claim a loss the PPC agent watching you should tell you you can't park there instead of letting a breach occur. Practically, if they were to actually manage the car park, they should also be approaching you to check if you should be parked there, or at least appreciate that even if the badge isn't correct (bearing in mind it isn't legally required), that some people obviously should be using those bays.
