sent letter to drp & private Co - drp response

Hi I have followed the templates to drp and the private Co after I received letters for drp threatening court since j parked in a disabled bit of communal parking at the new place j moved into for 5 minutes jn order to move a fridge in.

Drp responded and basically said

- don't bother copying Internet templates

- there are lots of clear signs in line with BPA

- they are in line with BPA point 22.7

- the time to appeal has elapsed and so access to independent appeals is not available

- sum charged is reasonable

And they basically want me to pay £160 otherwise they will recommend their client that court action be taken

I don't know how to proceed as they want £ by 26th August

  • ok we have worked out that the dent collection company is debt recovery plus , who is the parking company involved , and to whom did you make your appeal

    Standard DRP guff. Let us know who the parking company is (as per Freddy's post above), in addition read and follow the NEWBIES FAQ sticky (post #4) near the top of the thread list, one page back from here.

  • So the parking Co is uk parking control Ltd.

    I sent the template letters to drp and uk parking control.

    I ignored payment demand deadline from drp.

    Today they send a letter:

    'Reduced payment offer of £128 in order to comply with pre action protocol and they have referred my case to creditor with recommendation they appoint solicitor to commence court proceedings. ...if yiu don't pay it'll go back to £160 &referred back to creditor who may commence proceedings and this is the clients final offer to settle the case'

    Given the current mire UKPC is wallowing in, going to court will be the last thing on their mind in your case.

    However, going to court will be very much on their mind, but we're talking the criminal court, not the county court. But they'll be defending not pursuing!

    Just ignore, unless you get a LBCCC or real stamped court papers

    What template did you use for DRP? I'm not aware we have any - Post 4 of the Newbies sticky makes it quite clear what to do with them.

    DRP don't get any money unless you pay up - don't believe a word they say. They are also totally powerless to just ignore them.

    If you believe they are being in any was misleading (which they are), you can complaint to the Credit Services Agency* http://www.csa-uk.com/ who are the trade body for debt collectors.

    *I assume they are a member if they are acting as a debt collector. Their website only shows the badges of the BPA and IPC, so are treating it like a parking company, which is odd. You can always send complaints to the BPA and IPC too for being misleading. It's probably worth checking that they are registered with the CSA too, as if they aren't, they could be in a bit of trouble.

    The various templates I found here. One was sent to ukpc and another template I found for 'debt collector' or similar.
