Pothole Damage

On the 7th March 2015 I was travelling to work and hit a massive pothole which damaged the front offside suspension, wheel rim and tyre. The following day, I then revisited the road and pothole in question to take photographic evidence before the council had any opportunity to repair. On the Monday morning I immediately contacted Gateshead Council to report the pothole and damage to our car. I was then sent a claim form to fill in and submit.
Gallagher Bassett International the claim handlers for the council then wrote back to me to state that as they were aware of the defect, yet it hadn't been repaired, they're are unable to pay for the damage and deny liability for the damage claim?? As they were aware of this on the 18th February 2015, yet did nothing about it.
Where do we go from here??

That is surely a**e-about-face! AIUI the council is not liable for potholes it didn't know about but is very liable for potholes it knew about but didn't fix!

Possibly the council's insurers are telling you that they are not liable, but that's not the same as saying the council is not liable. I'd ignore the "claim handlers" myself and deal direct with the council.
You might do better to go up a level and post in the main motoring forum rather that this parking tickets sub-forum.Je suis Charlie.0
