Euro Car ticket with incorrect registered keeper

We unknowingly overstayed at our local Morrisons carpark by 40Mins on 29th July. We heard nothing until we returned from holiday on 14th August and found a letter on the mat from Eurocar dated 3rd August and demanding £85. As we left for holiday on the 7th after the post had arrived I can only assume it arrived on or after the 8th.

I have read all the Newbie posts so have already sent off an unhappy email to Morrisons with a copy of the food receipt (over £100) and was going to send your template letter off to Eurocar appeals when I noticed that the PCN had actually been sent to the company that my husband owns not my husband. My husband is the registered owner of the car in his own name and other than the advertising on the side of the car and the fact that he owns the company name there should be nothing relating the two together. If as Eurocar states on the letter they got their info from DVLA how did they put the two together?

Is there any ground for complaint via this as well as all the other points?

    Check with the DVLA that EuroCarParks actually requested the data. If they didn't then they're in a sticky place, as they would no longer be able to hold the registered keeper liable, and would need to pursue the driver only.

    Which of course they don't know.

    If the DVLA tell you it costs £5 and you need to fill out a V888, then tell them they are mistaken, you don't want the actual data, you just want confirmation that it has been accessed, and by who, in relation to a potential breach of the Data Protection Act.

    I am assuming the NTK is the first contact from Eurocar?

    If the vehicle is registered in your husband's name and the RK details make no mention of the company and the only link with the company is advertising on the vehicle and your husband's link with the company name, get in touch with DVLA and request information as to if RK details for the vehicle have been requested through them over the period 29 Jul to 3 Aug.

    If not, the NTK may be invalid due to the info not being gained through the DVLA, therefore keeper liability may not exist (in which case edit your original post to remove "While using my husbands car I ..." from the first paragraph so as not to be admitting to being the driver!)

    I'm sure someone more knowledgeable will be along soon with the party line on this one!

    Wait until their DVLA access window time for POFA2012 expires and reply with "_____ is not the registers keeper of vehicle _____. I recommend you contact them."

    At the same time, send a complaint to the ATA they are with about them not getting the registered keeper information from the DVLA.

    Complain to the DVLA first though. They won't be happy if they are being bypassed.
