    As he hasn't commented on how much it has already had skimmed off, he certainly isn't in a position to tell you what gasket should or shouldn't be on it. Sounds like he is trying to buy you as a client by rubbishing everything else that has ever been done on the car.

    Actually when he told me it was the head gasket he told me to take it back to the original bloke who did it and was set for leaving it to him to sort out as he did the car in the first place.

    I asked him if he would do it for me and he was telling me if i can get it cheaper from the original guy if he has done something wrong for it to go again i should go back to him. i sold my mechanic now that i wanted him to do it. He has actually said the last guy hasn't done a bad job he has just used the wrong head gasket thickness.

    I expect the last guy just bought a head gasket set and used whatever was in it. I have had sets with thinner or thicker gaskets; depends on the brand sometimes. I once replaced a head gasket and the one included in the head set was thin. It went again not long after. Bought just the head gasket on its own and it was much thicker. Maybe first guy should have retorqued the head bolts after 500 miles? Depends on the car though; some bolts are torqued to nearly breaking point now and can't be retorqued.

    So he's now gone from saying the last guy didn't do the job at all (which is a pretty serious accusation) to saying he did quite a good job but didn't use a thicker gasket. I guess that's a judgement call depending on how much was skimmed off the head last time, but very different from accusing the guy of taking money for a job that wasn't done.
    I would filter the new chaps comments carefully - he might be someone capable of doing a great job, but needing to have his moment of running down other peoples work. That might not be an issue as long as you can ignore it and he does the job well - some people are just like that.

    So it would seem the guy your accusing of defrauding you did actually do the work.

    As for any rights, you should have taken it back to him so tough luck.

    plus there's still no suggestion he did anything wrong and you've not just got a crap car with problems
