Letting Agent claiming back 8 months rent already paid to landlord

    You would have thought so.

    How then was the tenant able to recall eight months rent from the bank by claiming 'no advance notice received by the payer?'

    The tenant has disputed. So the bank has a duty to investigate. The monies will be reclaimed under the terms of the DD guarantee and held in escrow pending resolution.

    where my dd's have been fixed price, such as rent and water electric etc i have always been read the dd agreement and dates of payment, and they have sent this in the post, from there the payments go every month no problem.... for my variable dd's they read the agreement on the phone at the point of agreeing the contract, but the dd varies according to what i have used with no notice month on month. apart from like i said my credit card who will send a text and email saying my statement is available online. the phones dont do that at all.

    Do these mobile contracts and the landline issue you with a bill, either online or in paper? Because if they do, online or not, they have notified you of the amount.

    For instance, my EE account online says:

    "Balance from latest bill: £X
    "Payment will be taken: via Direct Debit on or around the 26th of every month"

    And the PDF bill says "We will collect £X on or around 26/8/15".

    I have been with: Greenbee Telecoms, Virgin Media, BT, Sky, O2 home broadband, O2 mobile, Vodafone, Orange and EE at various times, paying by Direct Debit, and each one has issued a bill each month (sometimes of varying correctness, ahem BT) stating clearly when my money will be taken. If you really have never been notified of your DD amount from your mobile and landline, please name and shame so we can all avoid them!

    Only some phone companies don't - unlike yours, my landline provider emails me when the latest statement is available and my mobile provider texts me likewise. Ditto my credit cards.
    IIRC all my other DDs are fixed (or only vary in the first or last payment) and I receive a schedule at the start of the year detailing what will be taken when - or, to be more specific, what will be taken and on or after when to allow for weekends, bank holidays, etc..

    i can confirm that i am online billing, but i do not receive a month by month notification from my mobile phone provider or my landline, when the amount changes... it changes its paid. gas and electric, if they need to alter my dd, i am notified always, my credit cards of which i have two also do tell me :) i have no issue with this phone thing though, at the end of the day i used it so i pay it.

    Are you sure you haven't told them not to email/text you - possibly when trying to turn off marketing communications?
  • My rent is taken by DD.


    When we signed the lease for the flat, I provided bank details. The letting agent told me to expect notification from their third party DD provider, which I received very quickly - stating that £XXX would be taken starting on X date and continuing monthly on X of the month, or within X days after that date.


    When we renewed the tenancy earlier this year (and the rent increased ) I don't think I received anything new about the DD. But I did when the agent changed DD provider, I got an email from the new provider stating they would be taking £XXX on X date and monthly thereafter. Obviously as that email came direct from the DD provider and the agent hadn't told me of this change, I confirmed that it was genuine.
