Hb and non dependents

Hello,
my daughter has now turned 18 and is working full time.
I have just received a letter from HB saying they need to reasses my claim because of this-which is fair enough, but i wondered, will she be treated as though she was 'my partner' and be responsible for 50% of the rent?
The first time we said hello, was the first time we said goodbye. As the angels took your tiny hand and flew you to the sky-you forever left us breathless. RIP my beautiful granddaughter :(

No, it will be as a non-dependant and the amount of reduction is based on how much she earns.

Have you informed your Council tax department ?
I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.
  • Thanks for that
Yes i informed the CT dept, who said they should have known this themselves and couldn't understand how they'd missed her. 2 months on i've still heard nothing but have reminded them this week.

You can get a copy of the non dependant deduction rates here:

    http://www.leicestershire.gov.uk/guide_benefit_rates2007-2008.pdf

It would be best if she saved £40 - £45 pw ready to pay the overpayment which you will eventually get.

I believe if you or anyone in your "household" gets DLA then you are exempt from a non dep deduction.

Sorry to sound stupid but what does that exactly mean?
Does it mean if there was for example a working non dependent and a non dependent on DLA/IS living in the same household as the claimant that the working non dependent would get full housing benefit because of the other non dependent getting DLA or am i barking up the wrong tree here:confused:
Can you tell i know nothing about benefits
"Life is not measured by the breaths we take, but by the moments that take our breath away."
  • Non Dependents (over 18) will result in a deduction in your Benefit unless you recieve DLA or Attendance Allowance. There will also be no deduction if they are in full time education or receiving Income Support/Job Seekers allowance.

The deduction is based on the non dependents gross earnings and not on any keep they pay you.

Your Benefit department should contact you to ask what your daughter is doing after turning 18. However if in any doubt you must contact them yourself in order to prevent an overpayment.

    Hope this helps,

Out of interest, if the non dependant is on a low income you might be able to claim Second Adult Rebate (DWP site) on your Council Tax.
    Torgwen.......... :) ...........
