Probate now online - is this enough to exchange house contracts?

Hoping someone has been through this and can help.

We are buying a house that has been going through probate. The grant is now finally showing online on the .gov website. Is this enough to now exchange contracts (it's been a very long process!) or do we still need to wait for the actual certificate? (Oath was sworn 8 working days ago).

    You don't need the grant to exchange, if there was a will with named executors, allthough most solicitors don't like doing it.

    The completion is is key bit and it will be needed to do the land reg bit so unless you suspect they may pull out exchange is not that critical.

    On the .gov website it says grant and will, so I can only presume that there was a will.

  • How long after appearing online did the probate take to come through? I'm in the same boat as it has now appeared online today. We are only waiting on probate before we can proceed with exchange.

    Without seeing the grant you can't be sure that the deal is genuine. Your solicitor is right to be cautious as they want to protect your interests. It may be infuriating but you will just have to be patient.

    In my recent case, time between returning oath to receiving grant was a couple of weeks

    It varies widely between Probate offices due to workload and staffing. There is no one size fits all answer.
