Flashpark Parking Charge Notice

Hi there, no need to mention i am a newbie as you can see that.

I have received this FlashPark PCN for £85 yesterday in the post for parking at 36 Mitcham Lane, London SW16 6NW on 1 Aug 15 @ 15:05. The picture of the car clearly showing the registration plate is included so no point disputing it but the only thing in my defence is that i was not there at the time mentioned in the PCN, i was actually in NW London in Harrow until atleast 4pm on that day and didn't arrive in Mitcham until 6:30pm approx.

I obviously don't want to pay this PCN which is offerering a discount of £20 ie pay £65 + £7.50 admin fee if paid within 14 days from the issue date ie 7 Aug 15.

Can someone please guide me what options do i have, just to make it clear i have not contacted FlashPark or appealed the PCN yet.

    Assuming this was for parking on private land as opposed to a council car park, have a read of the Sticky thread for NEWBIES. This tells you everything you need to know about how to appeal this.


    Use the template appeal letter in the NEWBIES thread making sure you don't reveal who was driving. Add an additional point that the vehicle was not in that location at that time and therefore the event never happened. Don't miss the appeal deadline.


    VCS/Flashpark are BPA members so the idea is to either get the ticket cancelled straight off, or to get a PoPLA code if they reject it. Getting the PCN cancelled at the PoPLA stage is relatively easy so don't panic if the PCN isn't cancelled at the first attempt.
    If you have any proof that you and/or your vehicle were not at the location where the parking event allegedly occurred, you will have a dead cert win at PoPLA.

    From Google Street View that address seems to be a public highway. Is this the case that you were ticketed on a main road? I note that much of this road is a red route.

    The other point that makes this not look like a private parking ticket is the 'discount' from £85 to £65 + £7.50 is nothing like the 40% 'discount' that must be offered on private tickets.

    Does the notification you've received indicate that the PPC is acting on behalf of the local council (or some other statutory authority)?

    Umkomaas, if you find 36 Mitcham lane you will see it looks an old building split into units with a small car park in front.

    Looks like they are a self-ticketing outfit that makes an income from selling signs and also paid tickets. http://www.flashpark.co.uk/

    However, they are BPA according to their web site and the discount offered does not meet the BPA CoP, so I would try a single point appeal on that basis (not a 40% discount - see BPA CoP for exact wording).

    Simple initial appeal saying you have not complied with 40% discount - either cancel or send me a POPLA code by return. Bet they won't want a £27 hit particularly as they won't have a compliant contract in force either.

    Nothing else - you can save that for POPLA

    Flashpark is indeed a self-ticketing operation run by infamous ex-clampit Costas Constantinou.

    Their signs are rubbish, tiny and crammed with small print (you can just about see them on Google Streetview) and they never have BPA-compliant entrance signs (which this site clearly should have because it's got businesses open to the public on it).

    And because they rely entirely on mobile 'phone pictures taken by any random stranger who happens to buy their signs they never have any evidence of a contravention that would stand up in court (unless they can get the snapper to be a witness, which doesn't sound terribly likely).

    Just look at this case: they've got the wrong time. All an appellant needs to do is to demand evidence that the photographic device was properly set up and calibrated and the snapper was competent to gather photographic evidence of alleged contraventions and pouf, their evidence goes up in smoke.

    Actually, there was a rerun on BBC1 last night after the news with the esteemed gentleman and his parking ticket that talks, Frankly, if I was in that area I would park a number of times just to collect the talking tickets as stocking fillers!
