Exchanged delayed as no EPC available

The agent needs to be explaining why they allowed the property to be marketed. They are as much to blame as the vendor,their inability to ensure all the legal bits they needed I.e an Epc to sell the property were in place is why there is a delay..0

Thanks Gonzo1987. I agree, however I can't afford for this sale to fall through given external pressures. I don't know who to threaten with what without chancing the sale not going though in the next ten days.0

Just point out to the EA (by formal letter) that unless there is an EPC in place within 24 hours you will be contacting Trading Standards.
The EA has broken the rules so will not want that to happen.0 -
Thanks G-M I'm just nervous that without direct contact with the vendor the EA could halt the sale by giving false info to the vendor and playing us off on each other. I feel powerless until exchange.

Pass the message via solicitors to avoid the EA. Make clear that the only thing holding up exchange is the vendors to provide the EPC.0 -
Does the vendor live at the property? If not, when your offer was accepted, did the EA send out a memo listing buyer/seller names & addresses and solicitors?I don't have direct contact with the vendor, the EA says they are chasing exchange & completion dates as well as me.
Send seller a copy of the letter you send to the EA.0 -
Update: I took G_M's advice and threatened trading standards if not done within 24 hours. The EA response this morning was they were trying to arrange another EPC today stating the same as they have several times over the last few days that it would take 24 hours to go on-line.
At 17:02 received an email from EA with just the EPC attached that had been done today, no subject on the email or other communication within. I checked on-line and the EPC was there, so the 24 hour thing was rubbish as well.
Anyway, thanks to you all especially G_M problem now resolved and exchange "should" go ahead Monday. :T :beer:0 -
Congratulations on successful resolution of the EPC saga. I didn't know some lenders require EPCs- I would be very interested in knowing which ones?
THe reason I want to know is that my vendor (a local authority) dug their heals in and would not provide and EPC (which I wanted to have in case we want to apply for the Green Deal funding).
They do not provide EPCs to anyone (despite being told off by the DCLG) and get away with it, since- obviously- the threat of taking them to the Trading Standards is pretty meaningless.0 -

Well, as I understand it from my earlier link, it is legally required for all sales. Maybe it is usually ignored or I've misunderstood?
My solicitor, rightly from my understanding, raised the EPC as a query. I would like to add that my on-line solicitor & mortgage lender (NatWest) have been brilliant at turn around times.
