The brother should send an Email headed Complaint to BG, asking why they have failed to issue a 42 day letter.

The 42 day rule was brought in to curb the exactly the kind of shennangans BG are trying on now -The rules also define that the date a Switch takes effect, is the day the new supplier actually starts the supply - Not the date the original supplier is advised that a Switch in process

That may not be the case; when RMR went live regulatory notification communication had to go by snail mail, but I also think it either has been or will be relaxed.
  • UPDATE:
After numerous phonecalls & denials of the 42 day rule I demanded the current call be recorded so I could be sent a transcript for the purpose of making a complaint to BG complains dept & Ofgem.
Suprise Suprise they suddenly appologised and said they now remembered the 42 day rule and would apply it straight away.

    You gotta love BG.

Glad that it is resolved; however, BG's CS team shouldn't be allowed to get off with a simple apology. I suggest that you report what has occurred to Ofgem at consumeraffairs@ofgem.gov.uk

Thanks for the update; it will help others dealing with BG.

I agree that you should report the matter to Ofgem's Customer Affairs. They may not take any action at this stage but if others report similar misinformation from BG, then Ofgem might then take some action further down the line. One can but hope the regulator will regulate for once.

  • I will report it to Ofgem.
I already reported it to BG but was told no action would more than likely be taken as all their new contracts dont have penalty fees so it wouldnt apply for much longer.

Seems like a lazy complaints dept to me.
Thakyou all for your help and advice :) it is very much appreciated.

What date did the 42 day rule change come into force?

My current contract is coming to an end at the end of Sept 2015, the start of this contract was on the 17/07/2014, so am I clear to make a switch without being penalised?

Your contract is covered by the 42 day rule, it came into force in Oct 2013. You can commence switching upon receipt of the notice or 42 days whichever comes first, 42 days being 19th.
